Not clear on process even with guides.

Timeline

At the risk of sounding stupid our situation is this, we are already married and used a lawyer to file for us - husband is UK citizen and wife is US citizen.. our petitions are at VSC and we are awaiting NOA2 (I-129F seeming to be processed quicker according to Visa Journey graphs).

One of the things we aren't clear about is what will it mean if our I-129F is approved before the I-130?

Happily married (save for distance) since August 2008!

NOA1: (130) Received within 2 weeks of filing.

NOA1: (129) Received within 2 weeks of filing.

I-130: Processed at 6 months 16 days

I-129: (F) Processed at 6 months 16 days (day before my birthday thank you USCIS!)

NOA2: (130) Received 6 days after approval.

NOA2: (129) Received 6 days after approval.

2nd July 2009 - NVC Received Case And Assigned Number.

10th July 2009 - Notification Received Stating K3 Package Sent To Beneficiary.

20th July 2009 - A One Sheet Letter Received With URL To Forms Required To Be Filled.

5th August 2009 - Medical Arranged.

14th August 2009 - Medical Taken.

27th August 2009 - IV-15 & Related Forms Signed For At London Embassy.

26th October 2009 - K3 Visa Interview - Approved! :D

..a lot of stuff..

December 19th 2011 - AoS Approved.. and sixteen Elephants fell from my shoulders.

Most likely that will not happen- at least that's been the case for nearly all of us these days. The I-129fs are processed more quickly when they are stand-alone petitions, meaning they are going for the K-1 visa.

Both of your petitions will probably be ajudicated at the same time and will likely follow the I-130 timelines.

NOA1 date: 04/17/2013

Biometrics: 08/23/2013

Interview: 10/07/2013

Oath: 01/23/2014

Thanks, the USCIS website has been updated today stating I-130 = 5 Months (?) and I-129-F = November 25th.. online nothing has been touched with our files - so if the I-130 is being processed first will the I-129F delay it?

It was my understanding that the I-129F was to potentially shorten the time we'd be apart :blink:

That difference in processing time is actually only 5 days. You'll see that those were the dates as of April 30th, so 5 months before then means November 30th.

As for the I-129f speeding things up- that's a misconception nearly everyone going for the K-3 has. Years ago the I-130 took much longer to process so they invented the K-3 to reunite families sooner. Nowadays since they are ajudicated at the same time there are few if any benefits to the K-3. Do some more reading on the boards about the difference between the CR-1 and the K-3. You'll probably end up choosing the CR-1. I fell for it too and the I-129f did slow us down- now we're just ignoring it and going for the CR-1.
