hello friends......

I am peter again....with your and all other VJ friend today i m in USA....by the way 3 week is passed in USA,i am waiting for the SSN and green card ...

before i ask my question, i want to mention tht, my passport has stamp like this. "upon endorsement serves as a temporary I-551 evidencing permanent residence for 1 year"

now, i want to know that when i have to apply for condition removal. USCIS says abt 90 days time framed ...i have arrived in USA on 20th may 2009..

pls guide me

Hello Peter,

Welcome to America, looks like you got residency via marriage. You will have to apply 90 days before you 2 Yr GC expires. So When you get your 2 Yr GC, it will have Residence since"xxx" and Card Expires etc. So subtract 90 days from that date. 90 Days is not 3 months. So you will have to apply within 90 days of your GC expires and remember not to file before as they will send your package back to you. Read the I-751 Instruction and form under USCIS forms section for latest form and instruction. So if your GC expires e.g 04-01-09 your 90 day window will begin approximately 01-01-09.

I would suggest, if you do get late in file give,file at leat 60 days before your GC expires so that you have ample time in case USCIS returns your application and also to get NOA ( Notice of action, which is application acceptance receipt + extension of residency status for 1 year while your application is pending) and biometric appoint letter.

Start collecting/making evidence like joint bank account, pictures, insurance, lease/mortgage, flights, car registration, phone and other bills jointly etc.
