I looked for a thread like this and couldnt find one, maybe someone could point me there or help me out. we are engaged to be married in August, if I go up there for the wedding, and while we wait for her paperwork to clear to come into the US, is it possible that I could get a work permit and stay in Canada while we wait?

12/29/2009 I-130/I-485/I-131/I-765 sent to Chicago

1/11/2010 Packet sent again, check was wrong the first time

1/15/2010 NOA 1 for all 4 forms

1/29/2010 Letter for Bio on 2/17

2/1/2010 Bio Done

2/1/2010 RFE received for I-693 medical

2/12/2010 RFE received at Lee s Summit, MO office

3/4/2010 Letter from USCIS for interview date of April 15 at 9:30 A.M.

3/10/2010 EAD card production ordered

3/18/2010 EAD and AP received!! Now waiting for the interview!!

4/15/2010 A good interview! Approved for 2 years!

4/26/2010 Green Card received in mail!

ant dirt, I’m not sure how that’ll affect her moving to the US since you’ll need to support her financially when you both move back to the states, but I’m sure somebody else on here can tell you more on that. I can tell you a bit about the Canadian work permit though, as my fiance lived with me for a year in Canada on a work permit while we were dating. You first need a job offer from an employer willing to sponsor you. The employer must apply to HRDC to have a labour market assessment done . This takes weeks, I think it can even take a couple months in some cases, but you’ll have to look up the current processing times to be sure. Once complete, you can apply for your work permit at any point of entry. We just drove to the nearest border crossing and they issued his work permit right there.

The Canadian citizenship and immigration site has all the information that you’ll need, and I found it WAY easier to navigate and understand then the US one. http://www.cic.gc.ca/english/index.asp I don’t know if there are different procedures to make it easier once you’re married or not, as we were planning to go the K-1 route, but it’s worth checking into.

Sparky&Me has explained it well. I don't think it is a realistic expectation to be able to work in Canada while there to spend time with your fiance. The HRDC Labour Market assessment means that the company has to advertise for a Canadian to do the same job and only after proving there is no Canadian available for that job are they allowed to look at foreign employees.

You do need to have a US source of income - or a co-sponsor- to complete your fiance's AOS after you are married. You might want to take a look at those requirements now so they don't take you by surprise later on - there is good information in the guides for the AOS forum here on VJ.
