I would like to know how many of us VJ'ers were out of Status when applying for AOS and if and why someone may have gotten a hard time from the USCIS because they filed late!

Wasn't late and didn't encounter any problems.

Most people have no problems by filing late, except if it's been 1 year out of status or something.

Officially I guess. We filed late by one month and one day exactly as they only cashed our check yesterday.

Will let you know if we get in trouble of any kind though I hope not. Though it's more likely they will complain about the absence of our I-129 f noa2. :(

Did you forget to include it, or did you lose it? That might generate an RFE.

We didn't file late either. We wanted to start the AOS process immediately and apply for the EAD.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

Filed it three weeks after I-94 was expired. Problem with changing SS card to married name because I94 was expired. I need to change it when I received the GC.
