OK...so we got married within the 90 days but I am out of Status since then I guess.My I 94 expired on April 27th.....My question is what do I put on the I 485 where it asks "Current Status" ? I have seen several people here on VJ that were out of Status and had no problems at all being approved so how common is it for people to file after the I 94 is expired? We really wanted to file but everytime we almost had the 2000 $ (Medical and Fees for my son and me) something else came up and we had unexpected expenses......Now my In Laws are actually helping us out so we can FINALLY file.

Also what exactly are they checking for in the FBI Check? I mean all of us K1's had to get a FBI Check when we got the Visa so why another one? I got my second Visa (didnt use the first one) and left Germany only 4 days later.......

its not a problem, just put " Fiancee (K-1 visa)" on Current Status because that was what i put down. Even if you are married now, but your visa shows that you are a fiancee. Don't worry, its gonna be just fine:)

Oct 2005 - met my baby

Dec 2006 - he proposed

Feb 2007 - K-1 filed

Dec 2007 - K-1 Visa Interview (denied), the reason: i was overstayed my previous visit in 2000-2003 (my bad)

Feb 2008 - I-601 Waiver filed

Sept 2008 - Waiver approved (K-1 Visa issued)

Jan 2009 - the Wedding Blessing & Reception (Bali, Indonesia)

Feb 2009 - Arrived in the US followed by the Civil Wedding & Reception (again:)

March 2009 - AOS filed

April 2009 - Biometric

May 2009 - EAD card in hand

Aug 27th 2009 - AOS Interview (approved, yaay)

Sept 2009- Green Card arrived in the mail...yippeeeew...(i want to sing of Your Love forever)

June 2011 - ROC filed

July 2011 - Biometric

Dec 2011 - ROC approved (Best Christmas ever, i must've been a really good girl this year :)

The wait would be unbearable but it'll be worth it. It strengthens the love, it attaches you even more to each other, it shows how your man would do whatever it takes to be with you, that he will never give up on you because he LOVES you!! All the waits, stresses, tears, heartaches, all the miserable feelings you feel along the way will be paid off once you get what you've been hoping for...oh and WITHOUT PRAYERS? will be like trying to start a fire with water, JUST WON'T WORK!

You are out of status, but you have married within 90 days. As you are applying after Your I-94 is expired. YOu can put K1 VISA HOLDER OR K1 VISA in current status field. Alot of ppl filed after I-94 expired and got AOS approvals smoothly. Yours will be fine too.

Is anything like this EVER 100% certain in the immigration process? Please avoid making such sweeping statements.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
