Hi everybody,

Sorry if this is not the correct place to post this but this is my first post although i have read you guys for a while already.

Here is my case:

I got married to a Bipolar-esquizo man, he stopped taking his medication and he turned to be aggressive and he abused me, got plenty of witnesses, we have been married for 5 months, he called the other day and said that if i didn't pay for an annulment and stated that he was gay he was going to get me deported, i had to ask for a restrain order and i apply under VAWA through a lawyer although i already applied for a greencard as his wife, i got the Advance Parole already and I'm about to get my Work Permit, my question now is...can i use the Advance PArole from my first petition as his wife although i already applied under VAWA too ? I'm kind of confused cause i applied for VAWA 2 weeks ago and I'm getting divorce and i wanted to stop the first process and my lawyer was supposed to take care of that but i just got the AP on Friday, not sure if it's because legal documents coming from Chicago need a little bit more of time to adjust or something.

I wouldn't think you could use the AP since it was based on your pending application. If you pull that application, then the corresponding AP would be null and void.

What does your lawyer say?

(your correct - they are different documents, so they can vary in where they are at in the process...)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Whether the abuse happened or was made up is irrelevant in my opinion. I'm still trying to understand why somebody who married an abusive partner feels they have the right to get permanent residence without completing the normal process. Seems like another way to circumvent the rules to me.

If a spouse become abusive before the greencard arrives and the other spouse wants to end the marriage before permanent residency is acquired, it should be filed under "IT DIDN'T WORK OUT" and the alien should return to a place where they do have permanent residency.

This is absolutely no different that a marriage that ended for any other reason prior to permanent residency, things didn't work out, go home. But this "program" is a neat way for the aliens to claim abuse to try to get a GC.

well, by parts.

For my VAWA case, i have notarized witnesses reports, a few actually, plus proves of emails, text messages and phone calls of him asking for money and saying sorry about things that he has done, i even wrote a column in a newspaper about the last night i saw him one week after he beat me up, my lawyer has seen it and so far said that the case is going to be easy, honestly, i didn't know why i stand him for so long.

Why i want the advance parole? well, in the last 2 years i have been outside USA for a week, because one thing or the other and since i got married months ago i wasn't able to get out, now with VAWA i will not be able to get out at least for a year, is this fair? i don't think so, after going through everything i have gone through i would like to see my family and be surrounded and hugged by them. It is just not fair that that mother f***er can go to his house and hugh and be hugged by his family that is at least as crazy as he is meanwhile i have to be so far from mine for so long.

I divorced him, i had to go and get it to court, i had to pay a lawyer, he cleaned our joint account where he put not even a cent, i was the one that got beat up, i think i have my right to ask for what i think should be fair for me, YES!

Sorry people, I have been looking for it, i swear, but couldn't clear up my mind, what does PRIMA FACIE mean? is it a time to show proofs of the abuse? why people's prima facie does get expired? it means that in all the time that uscis gave them they couldn't find enough proofs to show the abuse?
