Hello, I understand that the I-134 is basically stating that immigrant fiance(e) wouldnt end up on public assistance.

Does this include medicaid? so if she does become sick she can go to the doctor.

or public assisance do they mean food stamp?

also what is the poverty lever in the USA.

I made 35k in 2004 and 43K this year, is that enough?

Thanks

The alien is not considered to be a public charge if she uses medicaid. Actually, food stamps are not considered public charge either. Read this PDF for USCIS's public charge policy.

Hello I recently went to the USCIS website and I found this

http://uscis.gov/graphics/publicaffairs/fa...ets/afffact.htm

She can't applied for medicaid, how in the world are they expecting people making just a little above the 125 poverty level to be able to afford medical insurance?

Also read the session where it answers what are my responsibility as a sponsor (almost at the end)

With your income, it is unlikely that you would qualify for medicaid based on income level.

knight,

Actually, the I-134 is simply providing some financial information about the person who is offering to sponsor a visa applicant.

The I-134, along with other financial documents that the consular officer may ask for, will be used by the consular officer to decide whether or not the visa applicant is likely to become a public charge.

So Yodrak, what you are saying that after she gets her AOS for her and her son, she can apply for medicaid?

I only made that much was because I averaged 73 hours per week for 50 week. But If I would have been doing 40-45 I would have done about 28-29 K.

knight,

I said nothing of the kind. I clarified what an I-134 is useful for when applying for a non-immigrant visa, in particular a K non-immigrant visa. I said nothing at all about adjustment of status or medicaid.

You haven't provided enough information to hazard a guess as to whether or not your fiancee - and her son also? - is likely to meet the public charge requiements. Your current earnings is one necessary piece of information, but it's only part of the puzzle. And there's only one person who can answer your question after they have reviewed all of the financial information that you provide to them - the consular officer who is processing the visa application.

that link doesn't show what the 125% is...you would have to figure that out and add it to the figures shown.
