I have a question k-1 or k-3

Hello everyone as you may have read on my page I just got engaged in May and we started working on the k-1 visa but hit a road block with finances but anyway I was wondering which would be better the k-1 or the k-3. I know the k-1 is said to be a little faster then the k-3 and that there are other things about the k3 i have read about. I just dont know what will be best for us. This will be the first marriage for the both of us neither of us have kids and im still in college but graduating in December. I guess I just really want to find the smoothest route possible.

K1 is the only option if you're not already married - that said, K1 might be faster in that the foreign fiance may get to the US a bit faster but once here will have to adjust status and get EAD in order to work etc. This takes time and money. These are things to consider.

If you're already married - the best path (less stressful, and cheaper by a long shot) would be CR-1 instead of K3. Either one takes a bit longer than K1 but there are added benefits on the US side. CR-1 for example won't have to file for AOS (K3 does) - their PR/Green card gets mailed to them within a couple of weeks so when they arrive (essentially) they are already a permanent resident. This is a huge benefit.

So 'better' can really depend on what your intentions are when you arrive in the US.

We are not married yet but i have a returned visit planned for christmas and I know for a fact that this may be my last visit to jamaica for a while and we dont know if we should marry there and go with the k-3 or as u mentioned the cr1 or file for the k-1 wait and just have me visit when we get an interview date.

Faster isn't always better. The K-1 is definitely the fastest; however, I don't think it is the best. In my case, I went the K-3 route. I have copied & pasted the link for the comparison chart.

I've always heard the K1 is the best route. I can't tell you where and when I read it but my lawyer also said the K1 is the best way to go...................Sorry I can't be more specific

If you want to get married before filing then the CR1 visa is the best way to go, especially because it's a lot less expensive due to the fact that you won't have to file to Adjust Status and your spouse will get his or her green card weeks after he/she arrives in the US. While with a K3 you will have to not only apply for AOS and pay an additional $1,010, but wait at least 3 months for their work permit and then another 3-6 months for their actual green card.

Also, the CR1 and K3 are pretty much processed in the same amount of time give or take a month or two for people going through Kingston, Jamaica.

07/20/11 - Oath ceremony - same day as interview

Timeline

If i am correct you are engaged and not married? You can only file for Fiance visa at this point. However if you do get married then you have K3 or CR1 category to file for. CR1 is a bit longer but work out cheaper in the long run.
