Good morning to everyone here in US and have a good day on those others.... :)

My situation is we filed the EAD 1st then we will do the adjustment next month. I have my EAD now for 3 months and i am working and my EAD has a validity of 1 year so it will expire on march 2010, i need to adjust my status next month already and i know that EAD is included in there so they will give me a new one.I'm a little bit confused coz my 1st EAD is still valid when i will get the new one(from adjustment of status).

So this r my questions, Do i need to return my 1st EAD to USCIS when i get the 2nd one(from the adjustment of status)? lets just say i will get the new EAD on october 2009 if we file the adjustment nxt month. Do i need to surrender my 1st EAD and stop working because they will give me a new one? Do i need to surrender my 1st EAD and stop working in order to adjust my status? I will just keep my 1st EAD continue working until the new EAD arrive? Or I will just include a photocopy(front and back) of my 1st EAD and send it with those adjustment of status documents?

Anyone here had the same situation before or who filed EAD 1st then Adjustment of Status later?

Please help me. I need some input.

Thanks for the help and Godbless... :)

You will not need to do anything with your present EAD. It remains valid until March 2010. In fact, by that time you are likely to have your green card anyway, so you wouldn't need the EAD anymore.

You do not need to fill in the application for EAD when you file for your AOS. You already have a EAD so no point in filing for another one.

You should have your greencard before your EAD expires but if for some reason you dont then all you need to do if file for a renewal EAD including a copy of the NOA1 for your AOS and it would be renewed with no fee to pay.

Sending the I-765 with the AOS is optional. Not everyone want s to apply for the EAD. Also people like you who are K3 visa holders and have already filed for EAD dont need to file again.
