What should we have to secure with I-864 for my student husband?

Good day!

So here's the catch. My husband is a student and definitely has no income. So we have my mom in law to co-sponsor us.

And we have all the docs needed from my mom in law.

My questions are:

•(I may sound stupid but) Does my husband still have to get tax transcripts etc to prove that he doesn't have income at all?

•Do we need/still has to have written explanation why he doesn't have the AOS components for himself?

•From the USICS site, I've read that we have to notarized the Signature in I-864A, did you guys followed this?

And do we have to do the same in I-864 too?

and tips you can share guys will be highly appreciated.

Husband needs to do a complete I-864 as the petitioner and primary sponsor. If he did not file tax returns for the past 3 years he needs to explain why in writing.

Mother in law will do an I-864A if they live in the same household or she has claimed him as a dependent on her last tax return. If not, then she does an I-864.

864 and 864A do not need to be notarized. See the forms for all the details.

My husband and my mom in law lives together and he has been a dependent on her. So we had the I-864A filled up.

So my husband just need to have a written explanation why he doesn't have tax returns. (Copied!)

I see that you took the route of K1.. while us in CR1, don't they differ in some ways esp on AOS stage?

If we have it notarized, do you think its gonna cause us problem?

The I-864A form does not have a place for notarization. It is not required. It won't hurt, but it won't make it anymore meaningful. See the form here -> http://www.uscis.gov/files/form/I-864A.pdf

CR1 does not have an adjustment of status. You will receive your green card (actually a stamp in your passport) upon entry into the US. Actual green card in the mail some weeks later.

For K visas the AOS is what you are doing with the I-130. We had one extra step (and more fees) than you will.

Your husband must fill out an I-864 and attach an explanation of why he was not required to file tax returns. Just writing the explanation letter is not enough.

Oh you must have misunderstood my previous post.

Yes, my husband still need to fill out the I-864 and together with that is a written explanation why he was not required to fill for tax returns.

no need to notarize the 1864 and 1864A... We didn't notarize those forms..

My husband has been really busy all this time, that he has no time to compose our packets, so I was thinking if its ok that I'll be the one who will send the IV package to the NVC though he is my choice of agent?. ( I am here in the Philippines by the way.) Edited June 16, 2009 by LÜvtechwifey

yes its ok Cath.. just make sure your docs is complete.. PC, NBI etc...

base on my personal experience..the way i got here my husband completely straight 3 years no taxes.. not even a student..we went and go ahead wrote a letter of explanation. and then have i864 for my father who at least earns 50k a year just to make sure to be above poverty guideline, after a month waiting ..for the visa during the jurisdiction in us embassy in manila they requested me to have notarized explanation of the setup like where to live, whos going to finance and etc...certificate of employment of my cosponsor
