My wife is an F1 student from China. We lived together from Feb 08 to Jun 08. I then transfered to another university and we married when i came back to visit her. Eventually, after about 5 months, I decided that I could not take the seperation and transfered back to the original university so that i could be with her. We have been living together since Oct 09. We do not have a lease agreement, but the landlord is willing to write a letter stating that we have lived together during this time. How will our temporary seperation affect my I-130 petition and her prospects of an AOS. Would it be a good idea to write a statement explaining the circumstances of our seperation?

Everything can be explained with a statement, draft a letter explaining why you didn't live together during that period of time.

Tell the truth, USCIS has to understand that there are various situations in which spouses are prevented to live together, studies is one of them...

Besides the letter of the landlord is a good idea...

Am I missing something? Why do you want to write a letter? For what purpose? Has USCIS asked about it? I don't think it will come up anytime during the application. It might come up during the interview and that will be your chance to explain it if it comes up.

Im worried that since my wife and I lived apart so soon after being married that it would raise flags with USCIS. For this kind of case, it seems that the most important thing to show is that we have lived together during our marriage. A couple of immigration attorneys told me that they really enforce this no matter what the circumstances. It may not be so important at this point, since we are living together again. I figured a letter would prevent a RFE. An attorney has since suggested that I do not send any kind of letter.
