This might sound stupid but i've been reading the forums and there is just so much.

Applied for the I130 the I129F waiting for NOA2

When it comes time for my medical will my daughter need a medical too, also will she be scheduled for a interview when the time comes. What documents are needed for her. The okay from the biological father, court documents, passports, birth certificates anything else. How does this work with the child.

Yes, you wil need EVERYTHING for your daughter, you have to file for her too, as an adult. It means, medical checkup, pictures, I130, I485, just the fee is a liitle less for her, but everything else is the same.

My case might be different because I'm married with a US Citizen. But for you, I think, first of all, you must establish standing with the spouse, then the dependent. If the visa has been granted for the spouse yes, you file for the child. In my case, we filed within days. The process was the same in both cases with filings separated by days.

I am married to a US citizen but my daughter is from a previous marriage. We filed the I130 not sure if we had to list my daughter (need to ask my husband) but I know for sure we put her on the I129f. Just so confusing eh ??

I have her passport, and her long form birth certificate, vaccinations, court order with sole custody and permission to move. Do I still need to do the I130 or is the I129f good enough. do i fill out a I129f for her.

For now, you just wait until the I-129F is approved. You have everything you need. Once the I-129F is approved, you will then submit visa applications for your child.

You don't fill out an I-129F for your child.

You will fill an I-130 for your child once she enters the US on the K-4.

There is more involved but it's late at night so for now you shouldn't have to worry about anything.

It's similar to my case, my daughter is also from my previous marriage. We filed I130, I485 to get her SSN, we suggest you to do the same. She will need medical check up, pictures, all the documents that you filed for you should also be filed for her, I mean marriage certificate, divorce, tax forms, birth records (in English), and the appropiate fee for those forms.

Check with an Immigration lawyer for the final say. Hope this helped.

When you go for the interview just make sure that you have all the things that you say you have (especially the permission to leave declaration for the child).

Im not sure about canada but here in england if the child is under 14 they have the same medical as the adult just without the exray and bloodtests.

I guess you've received your NOA2 for your I-130 and have filed the 129F. Hope you've filed a separate I-130 for your daughter. I'm not sure about the K3, my kids came over with a CR2 but the only difference between theirs and my petition was I had to have the certified, judge endorsed court documents that demonstrated I had SOLE custody and PERMISSION for them to move. Do NOT rely on just a promise or an uncertified letter from your daughter's father. Also, the medical and police clearance varies depending on the age of the child. This was my experience from Ontario.

I wonder if you were remembering a prudent step to take....

For awhile, K-3 I-129fs slowed down to such a degree that I-130s passed them by. Petitioners who had been counting on the K-3 being the faster process (as usual) and having the kid come along on the K-4 were in for a rude shock when they discovered that the kid can't follow on the Immigrant Visa and need their own I-130.

Some folk were advocating filing an I-130 for the foreign spouse AND an I-130 for the kid right from the get go. The kid will need it sooner or later, and it's a bear to be stuck overseas waiting on it.

True. But it sure can complicate things if petitioner holds off on the I-130s for the kids if the I-130 for the spouse is appoved quickly and the immigrant visa starts to look more attractive than the K visas.

I can't think of any good reason to hold off on the I-130s for the kids rather than submit them at the same time as the one for the parent. (If money is considered to be a problem, then there are bigger issues to deal with than the I-130s.)

I was just pointing out the "regulation" on K-4, not necessarily the best practice. But yes it is a good idea to submit an I-130 for K-4 as soon as possible.

I made a proposal to add K-4 information to the visajourney K-3 guide. It seems like a good idea to do so since so many people have questions about the K-4 process and few knows the exact procedures. Perhaps you Yodrak in your spare time can write up some K-4 information and submit it to the site administrator. See my post in the site related forum.
