My fiance has mortgage loan dept and he is paying every month for 1200 dollars but now he told me that he cannot afford and will stop paying from now and we are waiting for NOA2.

If my fiance stop paying, is it effect for our K1 visa? He has income 60,000 dollars and above poverty line.

Most likely won't be a issue that I know of ... as long as he doesn't loose his job and income ... that is what they are most concerned about .. however the bank will take his home if he stops paying for it lol

No, they are only interested in his income, which is fine. However as stated, if he just stops paying the bank will take his house and he will lose any "equity" that he has in it.

If he really can not afford it, maybe he can contact his bank and negotiate a lower payment or something.

Having the bank take his house will cause him to have a bad credit history mark which may affect his ability to do things financially later on. He really should not just stop paying; that is the worst thing to do.

But it will not affect your visa process.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

It will not affect your visa, but it could have a serious impact on your lives together in the US (in terms of interest rates, future ability to own a home/rent, buy a car, etc.). Definitely have him reconsider his mortgage options. If he can't afford his mortgage, how will he take care of you (at least until you get a green card/employment authorization and job)? Can he even afford to apply for your green card ($1010)? You should really apply for your green card as quickly as possible after the wedding, if you don't you could find yourself fighting deportation, which will cost a lot of money and cause a lot of stress. These are just things the two of you should discuss. Best of luck.

It is not an issue for the affidavit. They do not ask about obligations and do not care (except IRS tax leins or unpaid child support)
