Thanks for the response, what are you saying makes sense, However my question was should I apply for AOS and Expedited advanced parole together or do the AOS first, wait for the reciept and then file in person via INFOPASS for an expedited expeditd AP

The latter seems to be the consensus way to go about things.

I was following up with requesting ppl who had been through this process and can share stories of what worked and what did not

If I am willing to pay a charge, can I make that appt. with INFOPASS, without having recieved my recieving the NOA?

Do you know how much the charge is?

The reason I ask is time right now is much more imp than paying, so if I can speed it up, even by a few days, but paying a little, it is very very worth it

The normal cost of the I-131 is $305.

However as JerIII pointed out, and as I have posted, you need the NOA from the AOS to actually be granted the AP. (sorry if I didn't make that clear).

Aliens in the United States should, prior to departure, obtain an advance parole document in order to return to the United States after travel abroad if they have:

•Filed an application for adjustment of status but have not received a decision from USCIS;

•Hold refugee or asylee status and intend to depart temporarily to apply for a U.S. immigrant visa in Canada; or

•An emergent personal or any other non-emergent bona fide reason (such as a need for business travel) to travel temporarily abroad

Now, USCIS may make an exception at the infopass appointment, and grant you AP before the AP, if that happens, you would need to pay for it, since you have no pending AOS.

(that would probably fall under Humanitarian Parole)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I dont think I qualify for Humanitarian Parole. That seems resered for very extreme cases.

I am hoping with a letter from a physician as well as the marriage invitations, hotel arrangements etc., they would consider granting me Expedited Advannce Parole, which I will apply for , in person, after I file for AOS first this Tuesday.

Anyone in the same boat as me, either now or in the past?

When we sent in our AOS back in January, we sent the AP application too; we were not really expecting to use it, but then a situation came up, and my wife had to go back to her country by end of february; we found out about it in early february, so we had about two weeks to take action. Also, our problem had nothign to do with family illness, but a business situation; if you look at the ap requirements, it says that you can also claim a bona fida reason.

We did the infopass and the people there told us that they don't do ap in person. We tried to argue, but no avail. We finally called in, and it got approved.

my thoughts to you is, file for the expedited AP once you complete your biometrics. We were told this by the USCIS agents who said, 'before you apply for an expedite AP, make sure your biometric appt is taken care of'; so as soon as we got the appt for the biometrics, we did a walkin, and then that same day, we called in to have our ap expedited. And when we called in, the lady we spoke to asked us if we had done our biometrics. When we said we had, she said, 'good thing, otherwise, this would be a mess.'

You can try the infopass, but it seems that a lot of the agents working don't give a damn about helping people. But if you do the infopass to try to expedite the AP, make sure you have your biometrics done first!!!

By the way, we didn't really expect our AP to get approved since we read so many posts about ap's only being approved for emergency reasons, but it was approved! :)

Thanks or the response, Looking at your timeline, it seems like it went very easily,smoothly and quickly

I can only wish for a similar experience. i guess I could apply, wait a couple of weeks to see if I get a Biometrics appt in that time like you did, and then do as you suggested. if I dont get the appointment, then I should just take my chances with the expedited AP.

I dont want to get visas and non refundable airline tickets without knowing if expedited AP is a possibility or not

What do you all think?

If you were on a K-1, werent you allowed to leave the country without AP in hand, I thought K-1 ppl were only needed to have AP upon return, not departure

It doesnt make a difference in my situation, but I was just curious

Actually, is very strange cause for k1, if you look at the ap instructions, it says that if you leave before it is approved, then you abandon your application; however, i don't think it mentioned anything once it is approved. Now, when we talked to the uscis person, she said that once it was approved, wife could leave the country, and i could mail her the ap. But then another uscis person said that she needed to have the ap before leaving the country. So all we know is that USCIS people give you all types of responses, but one thing is for sure. Do not apply for your expedited AP if you haven't done your biometrics, as that will only delay you more. At least that's what we were told, and I have read that in these forums too. So as soon as you get your biometrics appt, do a walk in, and call in to expedite the ap. I think that's because the ap has the fingerprints on it, but i can't remember..... :huh:

I just hope my stupid #### lawyer shows some urgency, she is really starting to piss me off with her lethargy.

Hopefully file Tuesday, get my reciept by end of month and then go from there.

is 2 weeks a reasonable timeframe for NOA?

This could be irrelevant, since I have never applied expedited, but I received my AP before my Biometrics appointment. I'm not sure if this was irregular, but mine was approved over 10 days before biometrics, and arrived 5 days later. So it may not be impossible that your expedited AP can be approved even before your biometrics. Just a thought.

Well, it is, but at the same time there are all types of timelines out there. And as far as the other person saying that they received ap before their biometrics, its all possible. However, only difference is that theirs wasn't expedited. We got so many different versions from USCIS people related to the AP, but thats the one thing they all consistently asked---have you done your biometrics yet? So who knows what protocol these people follow.

Could someone explain the proceess of the Biometrics Appt.

When you get notice of the appt. can you go anyday on a walkin basis, or is there an assigned appt. at a certain location.

If it is a set appt. how many days is it normally from day of reciept.

The notice usually tells you the date you can go, all though, I have seen posts here where people just walked in with the notice and was allowed to do it at that time.

YOu get a letter with a specific date and time; however, you can walk in at any time, given that you have the letter with you and your marriage certificate. Suffices to say my appointment was to be done in florida, and I did mine in texas. Had I been in alaska, could have walked in there too. It is that simple.
