Hi People,

I need some advice, help etc.

I am on an F-1. Just married my wife, a US citizen and in the process of filing our Adjustment of Status( AOS) application. We plan to file in the next 2-3 days, so lets say June 15th. I asked my lawyer if I could travel to Indonesia for my sisters wedding on August 15th. She said I would need advance parole while my application was pending.

Then the problem. She mistakenly told me that I could leave the country even is my AP had not come in, and she would mail it to us in Indonesia for my return because we planned to spend 3-5 months there spending time with my parents and also visiting my grandfather who has been sick all of last year, and at age 88 may not have much time left( He does not have any terminal illnesses).

This of course is not viable because I now know that YOU HAVE TO HAVE AP IN YOUR POSESSION before you can leave the country.

I am left with a situation where I will need to apply for expedited advance parole if I have any realistic chance of leaving the US by August 12th to make it to my sister’s wedding.

I know that expedited advance parole is only available in certain situations. I have heard conflicting reports of whether or not a marriage of a blood relative would constitute a “qualifiable reason” for expedited advance parole.

My question is : What should my course of action be? I feel like applying for expedited advance parole cant hurt. But how should I approach it. Should I make the wedding the focus of my case and the fact that I have paid for tickets, hotels, and other expenses? i.e. Financial Hardship would result from me not being able to leave the US

Or

Should I plead on the grounds of the fact that my grandfather who is not terminally ill but has been very sick recently, may not live much longer and this could be the last chance to see him.

Or

Combine the two. His poor health, and the fact that my only sister is getting married.

I know we have all had different experiences in this tough and frustrating process. One things that often keeps me going is the stories of hope on forums like these. So please, be honest, be upfront, and share you stories and advice with me

Wedding probably isn't going to be a reason to do emergency AP - for the medical, they're going to probably ask for medical proof (they did for a friend of ours) so not certain how you'd obtain that.

Best advice I could give is to not commit yourself to the wedding visit - if it were me, I'd stick to my obligation(s) to get my status where it needs to be and not put things in jeopardy.

If you do go the emergency route - don't file AP with your AOS - instead submit your AOS then make an infopass appointment to do the emergency AP - bring whatever proof you have of the emergency and you might just get the AP then and there (or shortly after).

Well - the only way you will find out is to make an INFOPASS and plead your case.

Either they will grant it or will not.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

So shoukld I file via mail , make an infopass appt , and plead my expedited advance parole seperately

or should I file in person and ask in person? do them both together

Is there any discernable difference, timeframe wise ?

i would go in person - that is usually faster.

If applying for emergency AP you should do so in person.

Thank you for the responses. Has anyone has experiences with this kind of appointment. Any tips, both good or bad?

Thing to do, thing NOT to do?

It is pretty simple and straightforward - if they find your reason for emergency AP compelling they'll authorize it - otherwise they won't and you'll just have to wait like anyone else. As with any type of interview - be open and honest, bring evidence if you feel you'll need it and leave it in their hands. If it is a real emergency, they have no problem issuing the AP.

I think what is frustrating is the subjective nature of it. Some people have gotten it for a wedding,( which is my situation) and some havent

It totally depends on that day, that officer, their mood etc.

So your advice is I should file for both AOS and AP in person simaltaneously?

you can't file for AOS in person.

Only the AP.

OH Ok, are you 100 % sure about tht, I read somewhere that you could but I know there is a lot of unreliable information out there

So I should file , wait for reciept and then go in person or go as soon as I file assuming that by the time I get my INFOPASS appt. They will have reciveved my information

I am sorry if I come across as clueless, I really am.!!!

Yes - I am sure.

You will need the NOA for the AOS to get the AP early (without having to pay for it).

What did you mean by " wothout having to pay for it"

If I am willing to pay a charge, can I make that appt. with INFOPASS, without having recieved my recieving the NOA?

Do you know how much the charge is?

The reason I ask is time right now is much more imp than paying, so if I can speed it up, even by a few days, but paying a little, it is very very worth it

I don't think you can get an AP without the NOA. Unless you have filed for AOS, you can't get Advanced Parole.
