I've always wondered about something .... I read a article awhile back ... way back when we started looking at what our options were for her to come here so we could be together ... and I remember reading something about there are a allotted number of visas that can be issued from each country per year ... I often wonder if extended waits ( unfairness in the process ) has to do with this. Meaning if there isn't a number up for you ... well you are SOL until one comes up so they feed you a line of BS while making you wait. Maybe I am way off on my thinking ... but it is plainly obvious they do not adjudicate cases in order received .... they maybe proccessed and looked at in order received but they are defiantly not adjudicated ( approved or denied ) in order.

On a side note however, my SO and I knew before filing what this process would be like ... we have prepared ourselves for the worst but pray everyday for the best and speedy process.

I called them to require further information regarding our case and they told me they are currently working on cases from november 08 and it will be 2 months to get to ours! what a load of rubbish! I even said to her that cases were being accepted that were in January and febuary and all she said was "theres nothing I can do". I swear to god this better be BS! or else I'm calling off the K-1 and were moving to England and doing a K-3 because there is no freakin way that its right we should have to wait 7 months when some get theres in 3-4 and when I call them on it they just say "what do you want us to do about it". Absolute BS!!!!

:angry::angry::angry::angry::angry::angry::devil:

Hang in there. You're 4 and a half months ahead of me.

It is what it is, logic and uscis have nothing in common.

A while back I lost my original Naturalization Certificate, a few years ago I applied for a replacement!!!!

Unreal, expensive and it took 14 months for the replacement to arrive.

In the mean time I was in limbo, after 9-11 things changed, if I lost my driver's license or had it stolen I wouldn't of been able to replace it.

Now think of the logic, If I hit a cop in the mouth how long before the government can figure out who I am?

Yet it takes uscis 14 months to provide it on paper for you!!

Maybe things can change one day,

Good luck

Family sponsored visas (K-1, K-3, CR-1, etc types) are not under this quota/allocation.

Please check your facts before spreading mis-information.

OP - Life is not fair! It took me 32 months (yes almost 3 years) to get my (now) husband here because our consulate was so backed up. Use this time productivity and know it will pass.

Wow dudette .... the reason I put the line " I may be way off on my thinking" ... I read the article a long time ago and it was just something I have always wondered about and wasn't quite sure about ... I do thank you for "correcting" me ... my intention was not to go around advertising false information ... have a wonderful weekend!

Don't feel alone, its extremely frustrating. Apparently these are not real people like you and I. They have zero empathy but an abundance of apathy. I think no matter what there name is their initials is always B.S. ! We are just beginning a 6-7 month wait ourselves and I guess if there is a bright side its that you will feel like you really earned it when its over. We wish you the very best and remember here on VJ, you are never alone.

Hello

I would suggest you not to give up and carry on with K1 Process. Its the fastest way and you could say a shortcut to bring your fiance US. Going thru with K3 after getting withdraw from K1 would eventually make the K3 Longer. Don't even listen to what they say on phone. I was told that my AP (Administrative processing will take 60 to 90, but I got clearence within 3 weeks. when we first file fiance visa petition, it got approved within 3 months. PPl on phone and USCIS itself always give a lengthy time frame to process any case, but it doesn't mean they are taking that long. Trust me, Dont back off. You will definitly hear something soon.

Thank you everyone for your very kind and encouraging words. It means a lot to me hear people supporting one another on this issue as only people who have been through this process know how bad and frustrating things really are sometimes. I'm certainly not complaining about other people getting theres before mine, they've had to wait and be apart from each there loved one just like me so I'm honestly very happy when I see someone on here get approved. I was and still am a little frustrated by the lack of sheer human interest USCIS show. If i wanted a scripted awnser I wouldn't of even bothered to wait half an hour for the person to pick up the phone. Me and my finacee have had long discussion over our options and how we feel and what we can do and weve decided to stick it out and make it happen for us (I know we can't pyshically make it happen but persistance goes a long way).

I honestly mean this when I say this: I don't know where I would be without this forum or the kind and caring people who fill it everyday. Thank you and I hope everyone the best in there visa journeys and also in your lives.

Thanks again, much love

I just wanted to let you know I had this exact melt down over time when I filed our K-1. I almost gave up and did the IR-1 instead. VJ saved my sanity. In reality most petitions are processed in 6 months, some sooner. Ours took about 5 months and then we got out interview quickly and we have been together in the states for 3 months now...we filed back in Oct 2008. Keep an eye on Igor's list and keep your spirits up. The waiting is hard but once you are with your love it will seem worth it. Have you joined a thread with people that filed the same month? Good Luck!!

I have there are probably only 3 maybe 4 people who actively use it. A few have just moved on to the next stage of there journey which I'm very happy to hear about but its just that I heard this from them and I've heard absolutly nothing from my congressman in nearly 4 weeks after I asked him to help. I've called and emailed him so many times now its getting past a joke. Even if they had bothered to tell us at the very least that they have our file, then I would b slightly more upbeat about it. But I do apprieciate the value of this forum and the fact that things don't happen as they should as in theory december people shouldn't be waiting either and USCIS should be able to give decent updated information regarding your case. From the evidance I've seen so far and the lack of response from our congressman or movement in our case I'm expecting it to not even be close to 6 months atm. Thank you everyone for your continued support though. I'm keeping my fingers crossed extra hard for everyone to have a smooth visa experiance.

:angry::angry::angry::angry::angry::angry::devil:

I recently posted here about the unfairness of this process and I received plenty of negative responses, so I would be careful when expressing your true feelings in this forum. I could not believe it, but I was even insulted a couple of times and almost told to shut up because "life is never fair." What a joke!

There is no fair reason for the immigration process to be this way. If some people waited only three or four months, there is no justification to make others like you and I wait five, six, or more months, unless the government clearly explains why and the reason is one that truly deserves the extra wait.

This process is completely broken and it will never be repaired because people move on after they finally get their approvals, no matter how much they were mistreated during the process. I have also considered the option of moving away, at least until I get assurance (maybe through consular processing, which I understand is always faster) that I can move back together. However, that is a big decision that must be taken after a well thought out plan, especially if your financial situation will be greatly impacted as a result.

You have waited five months already. At least wait until the sixth month arrives before doing anything drastic, or you will have to wait many more months again for a new process, which is also broken. After six months they allow you to place an inquiry. Many times after such an inquiry your case is processed right away. It is at that moment that you can take the decision: financial stability or life with your partner. And this is especially important to consider if you are not allowed to work in a country other than the USA (if you need the job).

If I did not need the job, I would have moved a long time ago. I put up with this lottery because otherwise I would be causing unnecessary hardship on my relationship. However, at some point we must decide what is more important: love or money.

Think about your decision with a clear mind. And maybe you can take a month-long leave of absence to be with your honey while you wait the extra month. That will allow you to come back in the same conditions you were and spend good time with your honey that will make you less frustrated with this process. However, if you do so, do come back to check your mail, because I read over and over than USCIS website cannot be trusted.

Take care and good luck. I hope that you and I get a pleasant surprise soon and we can move on and let others suffer instead :innocent:

Actually you received a few negative responses and a BIG dose of REALITY...and still yet today you have not filled in your timeline showing your unwillingness to help others in the same situation as you, and you continue to whine about the process. Albeit I do agree the process could use some doctoring.

Now you resort to hijacking other posts to tell people how mistreated you were in your post and STILL one week later have not updated your TIMELINE...I agree with others I believe you are probably on the shorter end of the 6 month stick.

And yes you will notice by my time line I am a LOTTERY winner.... only 4-1/2 month from filing to POE from the Philippines A HIGH FRAUD COUNTRY....wonder what I did to deserve such favor. Nothing more than luck I tell you plus crossed all my t's and dotted the i's.

Good luck to you in you journey.

Don't, and don't even write it. Besides all of the obvious reasons, do we want to feed even one more morsel to the rabid anti-ALL-immigration psychos out there?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The more time that goes by, the slower the time goes by, and the more frustrating it is to wait. I totally understand. Ours has only been out for two months. But, already it seems like an eternity. I think the hardest part is the waiting because we want to be with our loved one so much.

But, like some of the others have stated, you are near the end of the wait. And it will be more than worth it. Starting over would just make you have to wait that much longer. Immigration does need to make some changes to the system. But, until then, all we can do is wait. And when our loved ones get here, make up for lost time.

Good luck. You will be in my prayers.

OP, if your congressman is being so unhelpful, contact your senators. They can also help I believe. It is ridiculous that you have had to wait that long for a response from your rep. I e-mailed my rep and senators regarding an unrelated issue a week ago and have already received responses from 2.

To everyone waiting, this is honestly the WORST part of the whole process. Who knows why some people get processed faster than others? There is no answer for it and that makes is so freaking annoying. Once you get passed this stage however, things usually go much quicker and a lot of time you can get more answers out of people. You just have to sit tight for now and know that things will get better. And 2 years later you will look back on it all and it really won't seem that bad at all. Wow, can't believe its been 2 years!
