I called them to require further information regarding our case and they told me they are currently working on cases from november 08 and it will be 2 months to get to ours! what a load of rubbish! I even said to her that cases were being accepted that were in January and febuary and all she said was "theres nothing I can do". I swear to god this better be BS! or else I'm calling off the K-1 and were moving to England and doing a K-3 because there is no freakin way that its right we should have to wait 7 months when some get theres in 3-4 and when I call them on it they just say "what do you want us to do about it". Absolute BS!!!!

:angry::angry::angry::angry::angry::angry::devil:

06/16/2009 - Our congressman actually made contact us for the first time in 4 weeks only to tell us they had written our address down wrong so here we are, still stuck in limbo with not a clue what's happenening

06/17/2009 - Called NVC on a off chance they might have it and they do!!!!! Woop woop. All we need now is that hard copy and were set!

Canned answers from the misinformation line. You are right, it's bs.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

I wouldn't put too much stock in what the call center told you. They don't actually have any more access to your petition/case than you do (via USCIS.gov). The stand answer is always something like "We are currently working on petitions from X/6-months ago" and until you have gone past that time there is nothing we can do..."

Doesn't necessarily mean you'll have to wait past the 6-month mark (obviously it could) when most folks do not. VSC is unfortunately (currently) running at almost 5-months (NOA1 to NOA2/approval) which is really high but they haven't always been that way...

This is the toughest/most-stressful portion of the journey - you are very likely in the end stages and hopefully will hear some positive news soon... :thumbs:

Thank you everyone for your encouraging words as I'm still on the way down from literally using the wall as place to smack my head in anger. You all know what its like to be away from your love one and to hear this when your already discouraged from the number of cases being accepted after yours is a heavy blow. It was my first contact with USCIS and I'm sure it won't be my last.

There will come a day (not now of course) when you two will have a chuckle about all this... for now, hang in there - get things ready for the next step(s) and for your new life together because when they start to happen, it is in very rapid order compared to the USCIS experience so far...

Doesn't help that our congressman hasn't even got back to me yet after 3 1/2 weeks and several phone calls and emails in between. But I guess we have no choice but to hang in there. They have to get to/ find our case sooner or later right?

I can understand your frustration. You are so close to the end now. I see the USCIS according to VJ the VSC is processing February filers. I think the average is 6 months. So hang on you are getting close. You are coming up on 6 months, so it should be soon. According to the VJ estimate you should have had you adjudication in the 2nd or 3rd week of May. If it hits the 6 month mark maybe you should call the USCIS again and tell them it is past the 6 months. I think that the adjudicators work on a case and let it sit for background checks then work on another one. I think sometimes when it sits for background checks. It may take time to get back to it. Good luck to you.

4-17-2009 sent K1 Petition

5-1-2009 USCIS received petition

8-4-2009 NVC sent petition to Manila

9-22-2009 Medical Exam (scar on lungs) will have sputum test done

9-28-2009 K1 visa interview (canceled)

12-02-2009 call the SLMEC for sputum test report out

:angry::angry::angry::angry::angry::angry::devil:

I recently posted here about the unfairness of this process and I received plenty of negative responses, so I would be careful when expressing your true feelings in this forum. I could not believe it, but I was even insulted a couple of times and almost told to shut up because "life is never fair." What a joke!

There is no fair reason for the immigration process to be this way. If some people waited only three or four months, there is no justification to make others like you and I wait five, six, or more months, unless the government clearly explains why and the reason is one that truly deserves the extra wait.

This process is completely broken and it will never be repaired because people move on after they finally get their approvals, no matter how much they were mistreated during the process. I have also considered the option of moving away, at least until I get assurance (maybe through consular processing, which I understand is always faster) that I can move back together. However, that is a big decision that must be taken after a well thought out plan, especially if your financial situation will be greatly impacted as a result.

You have waited five months already. At least wait until the sixth month arrives before doing anything drastic, or you will have to wait many more months again for a new process, which is also broken. After six months they allow you to place an inquiry. Many times after such an inquiry your case is processed right away. It is at that moment that you can take the decision: financial stability or life with your partner. And this is especially important to consider if you are not allowed to work in a country other than the USA (if you need the job).

If I did not need the job, I would have moved a long time ago. I put up with this lottery because otherwise I would be causing unnecessary hardship on my relationship. However, at some point we must decide what is more important: love or money.

Think about your decision with a clear mind. And maybe you can take a month-long leave of absence to be with your honey while you wait the extra month. That will allow you to come back in the same conditions you were and spend good time with your honey that will make you less frustrated with this process. However, if you do so, do come back to check your mail, because I read over and over than USCIS website cannot be trusted.

Take care and good luck. I hope that you and I get a pleasant surprise soon and we can move on and let others suffer instead :innocent:

Thank you everyone for your encouraging words as I'm still on the way down from literally using the wall as place to smack my head in anger. It was my first contact with USCIS and I'm sure it won't be my last.

I doubt that your case is actually lost. The information from USCIS that you quoted is from their script, plain and simple. Don't worry about it too much (if you can help it). Chin up, sit tight.

It sure is. Every time we've called them for a status update they have been extremely rude and basically read us the default response.

On another note, every time I've called them for things OTHER THAN a status update, they've been helpful.

The waiting sucks, but that's how it is unfortunately. Hopefully there will be some immigration reform to come. Just hang in there, I doubt it will be too much longer for you :) And it's all worth it.
