AOS, HIV Syphilis test, DS-3025, I-693

Timeline

HELP! We are getting ready to file AOS for my husband. He has an appointment with a civil surgeon in a few days to transfer his DS-3025 to the I-693 but we noticed it has no information about having had the HIV and Syphilis blood test that was done during his medical exam in Spain. Will the doctor make him have it again?? Can we just say no if he wants to because we know he had it less than 6 months ago and the instructions for the I-485 and I-693 both state that a K-1 visa holder does not need to repeat the medical.

Civil surgeons know that K1 already has the medical exam before coming here, what they will ask is the DS 3025 (valid for a year) which is the list of vaccinations. Yes you have the right to refuse not be tested again with HIV since you are not told or there's no additional info that you have to do it again.

The blood test medical results are in the file you turned in at POE in the brown envelope. Hopefully that makes it to match up with your AOS application. That's the plan, but some don't and then you have to do the medical exam all over.

If by chance you had every shot needed prior to entering the US and it's recorded on the DS3025, then you can send that (photocopy of it) with AOS and skip the transcribing and the Civil Surgeon altogether. If you got shots in the US, then those will have to be recorded by a CS along with whatever is on your DS3025.

Don't let the doctor tell you to do the whole medical over again. Many tell people that.
