Im currently confused as to what the NVC will request and what their process is for K-1 visa, I probably missed it somewhere or someone probably posted this or something like it already but i cant seem to find it.. The only information I have been able to find for NVC process is for CR-1/IR-1 Visa Applicants. If someone can help out this noob I would be pretty greatful for it as the NVC part is stressing me out with the confusion.

I do understand there is some kind of form and some kind of payment at this point when they get the case and give it a number.

K-Visas are NON-Immigrant, NVC simply sends them to the consulate, the consulate then sends beneficiary packets.

NVC only sends petitioner a letter indicating they sent the case on to the consulate.

so no form and no payment right now? and i just call or email to find out if they got it and sent it along?

No form and no payment, correct. You'll have to call them and speak to an operator. K-1s and K-3s are never put into the automatic recording system. Once they've sent it out you can track its journey with DHL or you can call the DOS to see if it has arrived yet.

5 days from NOA1 to NOA2? That's got to be some kind of record. They could've mailed your NOA1 and NOA2 in the same envelope!

Right. You don't have to worry about NVC process, since you are applying for a non-immigrant visa. They will just give you your case number then forward your case to your consulate. No payment nor forms to be submitted to NVC...but only to consulates, during and before interview (forms Ds156/157)

What do you mean k1 is non immigrant? It is for the fiance visa unless I am totally confused right now...which is entirely possible (long day at work. lol)

The K visas are non-immigrant visas in that there is no residency granted from the K visa itself. Your immigration status is totally dependent on adjusting status once you are in the US. If you do not then you will be out of status once your I-94 expires. The fact that you have an I-94 indicates that you are still technically a visitor. With the CR/IR-1 visas you are a permanent resident as soon as you are through the POE and so that visa is an immigrant visa. USCIS and the DOS say in a few places that they consider K visas to be both immigrant and non-immigrant. That is simply because you are granted the visa under the assumption that you will seek legal status and become a permanent resident and thus become an immigrant.

Check Cashed - 3/24/09

NOA2- Approval date 7/22/09 (hard copy received in mail 7/27/09)

Mailed copies of packet to Dave - 8/1/09

Dave mails in his checklist to embassy - 10/12/09

Filing for a K-1 Visa

My Chinese fiance got a request to complete the interview checklist forgot the form number and Form DS-230 and return them.

They didnt ask for DS-156, DS-156K or I-134 to be returned at this time.

Should she send these forms in anyway? or just bring them to the interview when it is scheduled?
