I was looking for information on visiting the US while we wait for our K1 to be approved and came across this gem...

12) Q: Can I prepare these documents myself, or use a fiancee visa kit?

A: You can do this yourself, but you run the risk of running into problems that can lead to long delays, or even denial of your visa petition.

The USCIS process is very complicated. If your application is not prepared correctly the USCIS will contact you requesting additional information. When a problem exists, it is very common to lose several months going back and forth with the USCIS trying to settle issues.

In some cases relationships will suffer because of the stress of the situation. Fiancee Visa kits are not a suitable replacement for expert service. Unfortunately, there are many people who use the fiancée visa process to circumvent the immigration system. Because of this, the USCIS looks carefully for "sham" relationships. If they can find an excuse to place your petition under investigation, they are perfectly within their rights. They can stall and delay the approval long enough so that one or both of you will give up. Many relationships have fallen apart simply because of poor preparation the original visa application.

That's like if you told people hey you know when you call those late night sex chat lines, you don't really get to talk to THAT girl.

Geez, whoever gets bitten by relying on information from a seller alone and does not do their research deserves to get burned.

And lawyers are just sellers like everyone out there...

Yeah, I think it's necessary. Have you never looked at the K-1 forum? There are new people every day asking "do I need a lawyer???". When you first start getting involved in this process it can be quite confusing and lots of people feel like they need help. I agree with you that only getting information from the seller is not a good idea, but at the same time, all of us are just trying to do the right thing and get our loved ones to the US ASAP. So, if a theoretically reliable source implies it's super difficult to do it without a lawyer, I can't see why they wouldn't believe that.

Not everyone finds VJ in time...

When I wanted to bring my wife over, first thing I did was googled "how do get foreign spouse into the US". I got a list of sites. My plane departure was only a week, and I wanted to find out if I could bring my wife over within the week.

Well, after vigorously researching USCIS.gov and a lists of other sites, I learned it'll take about 6 months....I was extremely upset! So, I began the petition....

During those times I found VJ to alleviate the pain of waiting...now my wife is here...so happy!

I see your point but I still disagree. We were all a little scared at the beginning, but as soon as you start digging a little deeper, you realize hmmm how hard can this be, I need to answer questions such as my birth date and addresses where I lived, and oh my I need to submit documents such as marriage certificate and passport. You should very quickly realize that this is not rocket science.

And for those who just can't figure it out and keep getting RFE after RFE, well they shouldn't have their spouses close to them to reproduce anyway :rofl:

if i had found vj i would never have hired an attorney.

here u only have to ask a few questions and they would have been answered clearly from those that know, i swear it is the attorney not addressing the two issues as we paid him and asked him to do that made this mess we are in.....

seriously for just about any petition for visa that i have seen unless there is clearly something that DOES require experience of a qualified immigration attorney do not need an to pay an attorney for simply putting ur forms that u urself fill out into the envelope and mailing them out along with the money order that u urself purchased and filled out.

there are many people here on vj that could open up their own business and charge less than the attorneys for the same service u get and make a million.

Do not see where that attorney is telling any lies, as a fairly intelligent natural born USC that never encountered immigration before, it is an extremely complex process. First you have to know that the USCIS even exists, not part of your normal work day, and once you do, run across this.

Unfortunately, we live in a country of laws made by lawyers and they go out of their way to make things extra complicated. In looking over my grandfathers immigration papers, like two of them, were once simple. Can't help but feel there is a conspiracy in this country from lawyers that are in our congress that go way out of their way to make things extra complicated and confusing so their fellow lawyers can make a darn good living off of us.

I found a darn good immigration attorney, had better things to do with my time than learn an entirely new subject, but picked up a lot of information along the way. We agreed on a flat rate to be paid only on successful completion of the AOS process, and that fee was just a little over half of what the immigration fee was. But if you find a bad attorney, you can have a very bitter experience. The trick living here, is to find not only a good attorney, but a good doctor as well. The IRS is another bad joke on the American people with over 11,000 pages of law and over a thousand different forms.

We the people are to blame for this, we let them get away with it.

I wouldn't say it was "scare tactics".

If you were clever enough to do this process yourself, then you wouldn't be looking at that lawyer site. :content:

Seeing some of the posts here, there are people that didn't bother to read the instructions (sending in proof of meeting, signatures for stuff, divorce papers) and they do find they are delayed if they got it right the first time.

Then again, there are posts from people that used lawyers, and the lawyers screwed up their paperwork....

So a little knowledge should go a long way!

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

allot of lawyers no sh!t about immigration except to fill out the forms...i have legal service through my company and when sanita recieved a 221g.( with recommendations to deny).i tried to find out for advice...and counsel.,..they have none ...they tried to find out out of their panel and did..the expert in st louis..i tlaked to her briefly..she had no clue what a 221g was or admin process...

i did it myself, called and talked to the director and was lucky and got the matter cleared up in a week
