Hello-

I will be filling my Citizenship application in 6 months, and I wanted to know what should I answer this question:

16- Have you ever been arrested, cited, or detained by any law enforcement officer ( including USCIS or former INS or military officers) for any reason?

Back when I was an F1 visa holder( a student) I got an early morning visit from ICE agents. I used to go to college in a state, and I transferd to another. Instead of the new college entering me with the same SEVIS code in the system, they assigned me a new code. Long story short, I was showing on the immigration records as being out of status... I explained to the agents, that I am still legal. They took my passport, and never arrested , or detained me. At 11 AM I got a call from my school to come pick up my passport. This issue came up on my adjustment of status interview, and the IO said she talked to the ICE agent, and everything is sorted out.

Now my question is should I answer, yes to that question or no ? Or should I just leave it blank, and explain my self @ the interview?

Since you were neither arrested, cited or detained I would answer No to that question. From your post it looks like there was just a misunderstanding and that they just asked you a few questions.

Answer no. There were no removal proceedings, just a misunderstanding. There are people who have been out of status and could still answer no to this question because the formal removal process had not begun.

Biometrics: 08/23/2013

Interview: 10/07/2013

Oath: 01/23/2014
