I-864 Request for Initial Evidence - Help please!

We have sent off our I-485, I-130 and I-864, we have had a letter asking the following:

In order to process your application further the sponsor on form I-864 (AOS) must submit all Federal income tax documentation submitted to the IRS for the most recent tax year.

We followed the instructions on the form and sent in the W2 and the Tax Return (1040A) for 2008, my husband (the sponsor) earns more than the poverty level.

We have no other tax documents to send in, when I called USCIS they just repeated the info on the letter.

Does anyone know what else they are asking us to send in?

If you're saying you already submitted an exact copy of everything (every page) you sent to the IRS when filing 2008's income tax return (everything such as any/all supporting documents - W-2, 1099, etc) then perhaps they have misplaced what you sent.

My only thought is either you sent something incomplete or they misplaced what you sent.

I would (unless there's something I don't know here) reply with the same thing sent originally (i.e., copy of all pages of last years tax return and all supporting documents - this may not be limited to W-2's). :thumbs:

Yes, you only mentioned 2 pieces of paper, but all my pieces of paper usually end up around 15, and I consider it to be fairly simple/typical. Make sure you're sending everything in.

Alternatively, why don't you see if the IRS won't send you a transcript. They are free, and then you don't have to worry about including all the schedules etc. Phone number for the IRS is 1800-829-1040. If you go this route, don't wait too long, it can take 15 days to receive them, which will eat up a lot of your RFE window.

Maybe do both.

Timeline

RFE window is the time period that they wait to allow for you to respond before they make a decision. If you don't reply during the specified period of time they will not wait and make a decision based on the material they have at hand. Generally, if they have sent an RFE and make a decision without the requested evidence, it will be a negative one. So, you want to make sure you respond quickly to an RFE.

When I got my IRS transcripts, they told me I should get them within 7-10 days. I would have, if they had not continued to use the wrong address for me even though I had corrected them. Twice. ;)
