Appearing for CR1 visa after traveling to US on K3 visa

Timeline

My wife just got K3 visa (Mumbai, India) and she will be coming to US based on that. She has her CR1 visa scheduled for Jul. I want to know if it is possible for her to go through CR1 interview if she has already entered US on K3 visa. I know K3 guide on VJ says that you can but I want to know if anyone has tried it recently.

What if you get both petitions approved at the same time. Can you drop the k-3 and only persue the cr-1 since you will save money?

Hey I go with the spell check function of the browser so if it does not indicate a spelling error, I miss it. The message gets across however it is spelled.

You can in a way, you cannot "Cancel" the K-3 without risking the underlying I-130 getting canceled also.

If the consulate uses P3 and P4 for the K-3 visa, simply do not respond to the P3. If they schedule an interview date for the K-3 simply contact the consulate and reschedule the interview or tell them you are doing the CR-1 and have that in process through NVC.

If the I-130 packet makes it to the consulate before the K-3 interview they should drop the K-3 in favor of the CR-1.

Since USCIS has been approving I-130 and I-129F on the same date lately, this effectively ends the reason the K-3 exists (Entry to the USA and WAITING for I-130 approval)

I know that this is what the VJ guide says but I was looking on NVC and USCIS website that explains this in normal person readable words. But didn't see anything. It says that person may file for AOS but doesn't says that they can go back and finish processing. Just want to know if someone out there has done this recently. Just to be double triple quadruple sure ;)

If you file for AOS, that processing is finished INSIDE the USA... this is quite different than a CR-1 visa.

If I-130 AND I-129F were approved at same time, more than likely I-130 is sitting at NVC waiting for you to send them I-864 and DS-3032. CALL NVC and check on status of I-130 petition.

Also wouldn't it be actually cheaper for you to file AOS in US than your wife going back to India. Or if the CR-1 interview is in July, she can wait for a month and attend that interview and come to US with CR-1 instead.

In my mind simple calculation is-- she comes to US on k-3 -- One way ticket --$800

She goes back to India, gives CR-1 interview, comes back again-- Round trip -- $1400 or so

That $1400 alone is more than AOS fee rigt? Plus other expenditures in India

Wow, that's cool. Which route did you get for $600? I was looking from Chicago to Calcutta and it was around $1500.

Wow, that's cool. Which route did you get for $600? I was looking from Chicago to Calcutta and it was around $1500.

She got it from India, for Ahmedabad to New York in Qatar Airways
