you have to meet the poverty guidelines if you are the primary sponsor

if you can not support the requirements then you will need a co sponsor who will fill out the I-864A form.

there is a USD70 filing fee for the affidavit of support.

I am on workmans comp right now so im not sure i will have enough to show so i want to check on the sponsor thing just incase.when i am working i make more than enough.

First, you ARE the sponsor because you're the one whose petitioning. If you get someone else to help then you'll be getting a co-sponsor, or what USCIS calls a "joint sponsor". I believe the USCIS term is technically inaccurate because it implies they're combining or "joining" their income with yours in order to help you qualify (like a joint tax return), but that's not how it works. They have to qualify on their own.

The USCIS rules for the I-130 say you only need to make 100% of the poverty level for your household size to qualify, but the rules for I-864 (which is filed after your fiance arrives and you get married) requires 125% of the poverty level, unless you're active duty US military. Most consulates, who have absolute discretion over whether they believe your fiance will become a public charge, require you to meet the 125% threshold with the I-130 because this is the threshold you'll need to meet later.

The 125% threshold for a household size of 4 is $27,562 for 2009. It may go up slightly for 2010, which is when your fiance is likely to go to her interview. Will you be working again by then? If so, and your income will be adequate at that time, then don't worry about it. They do want to see tax records, but current income is what counts. If you won't be working by then, and your income does not meet the threshold then you may be able to make up the difference with assets, provided the assets are liquid (they can be converted to cash within 12 months), and they total at least 5X the difference between your income and the 125% poverty level. If you can't make the threshold with income AND assets, then you need a co-sponsor who can meet the the threshold.

Note that the household size for the co-sponsor includes his or her dependents PLUS your fiance and any children who are also being sponsored - it does not include you or your dependents.

Note that Manila has been known to deny applications with co-sponsors unless they believe there is a very low likelihood the co-sponsor would abandon their responsibility. Your chances are better if the co-sponsor is an immediate relative of yours, and lives with you.

Ok well i dont have any family that lives with or near me so cant do that,im hoping to be back to work by the time the interview happens.if i am back at work by then i only need a couple check stubs right?also dont i have to file a I 134? says i need to in he guide here i didnt know i needed to do a I 130 also. where do i find the I 130? so if i found someone who would co sponsor it may not help? my income on workmans comp is only going to fall just below the poverty line of the 125%.it will be $24,320.16.so what should i do to help thigs other than getting back to work.?

yes of course i posted in the K1 section why wouldnt i? i stated in beginning i filed for K1 visa.

i am not married to her yet.

i understand i file the I134 but others for some reason keep talking about a I130 paper.

i still have a job im just off work from injury.hence the workmans comp.so no need to look for new job mne is stiil there when i return.just wanted to know info on the sponsor.if i do find one i just have them fill out same I134? and get proof of income right?do they have to state on paper there co- sponsor or just fill it out and give proof?

The I-130 does not apply to the K1 visa. You asked about the I-130. The K1 guide does not refer to the I-130. I wanted to be sure you were heading down the proper path. Folks do post to the wrong forum from time to time.

I was thinking unemployment, not w/c when I answered. Must be lack of coffee. :) Do you have an idea of when you would return to regular work? The affidavit of support won't be needed until the interview stage. If you're back at regular pay and that pay (annualized) is over the requirements then you will be ok.

You will have to complete the I-134 as the petitioner. If you do not qualify then the co-sponsor would complete an I-134 as well with all the supporting documentation. Manila may not accept a co-sponsor for the K1. Check with the consulate as well as on the PI regional forum here on VJ.

Ok, I am at a loss. If you were WAY above before what kind of workmans comp do you have? Usually it is 66% of gross. Anyway, if you will be abck to work soon, it is no problem. You do not fill out the I-134 for several months. Also, on workman's comp you are STILL employed, you are not working, it is not the same. You STILL have your employment at the base rate.

A co-sponsor will also complete an I-134 just like you and provide documentation of income, just like you. I have read here that Manilla does not accept co-sponsors unless they are immediate family, but check with the consulate.

If you had to do an I-134 today, you could take your year to date income from your job and add the workman's comp to date. Divide by the number of months (to date) and multiply by 12. This is your current annual income. Back it up with check stubs. If you get back to your regular job, just state the regular annual base income.
