Waste of time and money unless you have some issue an attorney can correct, which is very few

If you need professional help, go to a visa service that understands the process, not an attorney

I had an immigration lawyer that claimed over 10k successful K visas on his website. I paid him $1800 and he made no less than 10 mistakes, and also delayed my case for a minimum 3 months. Getting a live person on the phone, or for that matter a return email or phone call was impossible. Thanks to this website I corrected his mistakes. My wife received 221g at her interview, and he disappeared. An attorney can not speed up your case. By the nature of the USPS, or express messenger services, it WILL slow your case down. You still have to collect all the documents and send them to the attorney. This in itself is a delay that can not be avoided, no matter how good the attorney is.

Disclaimer... I am in no way advising, or not advising someone to use an attorney in this process. This is just what happened to me.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

it depends if you have a very a complicated situation like divorce or something that u think will be a great barrier on the petition... however, if you have no problem and so with ur hubby - NO NEED FOR A LAWYER unless your husband is a big time businessman and has no time in paper works...

To answer your headline Q: If your case is not complex, and if you have the time and patience to read and comprehend to the instructions when and how to file the forms and what to do next, you don't need a lawyer. Trust me, instructions are self-explanatory. But, if you are the opposite of what I have just said... Then, get a lawyer - or, just get somebody else who will just fill-and-send your papers....

September 2006 - Set foot prints in the chilly icy JFK, NYC

December 2006 - Civil Wedding

March 2007 - File AOS

June 29, 2007 - Temporary Green Card

May 30, 2009 - Priority Mail with Confirmation Receipt I-751 Packet

June 1, 2009 - Packed Received by USCIS around 4PM (per USPS Confirmation Delivery Receipt) - now, what's next?

June 2, 2009 - I-797C Receipt Date (Time 21:07....are they operating 24 hours???)

June 3, 2009 - Cashed Check/Bank Cleared

June 4, 2009 - USCIS Postage Date

June 5, 2009 - Local Post Office Receipt date (so, its been sitting on our mail box in house #2 for 5 days...)

June 11, 2009 - Got it! 1 year extension notice......

June 18, 2009 - Received Biometrics schedule

July 10, 2009 - Biometrics Day (cancelled/re-sched)

I wasted $1000 non refundable.....before i paid it they said (no problem your wife is ok to stay on her tourist visa for you 2 are married) after i pay they said ( your wife need to return to her country to file K3 or CR1) and how much it cost $2300.00 take it or leave it...goodbye to my $1000. The reason why i dont want to have an additional fee i have so much idea by searching online about my case than them.

Based on my experienced. (My advise stay away from immigration lawyer).

This is the answer I most closely agree with, particularly as it relates to the bold above. Different people have various skill and ability when it comes to reading carefully, interpreting literally and following precise instructions. Vive le difference! Often people either find the instructions FAR from self-explanitory or simply misinterpret the instructions. Buyer beware. What your buddy found simple may confuse the bejeezus out of you.

Immigration is not a "legal matter" unless somebody involved has a legal matter impacting their chances for success.

Facts are cheap...knowing how to use them is precious...

it is simple process and easy to do yourself

here all these people willl help u a lot

i made a mistake to pay $1000.oo to an attorney to do my I-130, and my attorney made a mistake on her name and now i have to correct it.

bcz i dont want to do anything for me any more. since i got rid of my lawyer it is smooth journey. thanks to all Vjers.

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

really?because i have a tourist visa too..and been to the states twice..my fiance been in my country twice..but were thinking of that before,married in the states during the validity of my stay..but say,its too risky especially if they found about u have the pre-conceived to immigrate

I expect "you" know little if anything about the capabilities of the "you" you say can do it themself. As such, you could be dead wrong. I see your wife hasn't yet received a visa. When she does, maybe you can say it was simple for you but you are quite foolish to make such a statement about what will be simple for a stranger.

I think this has been aptly covered here in that if your individual case has little in the way of complications. Then by following the guides here on visajourney the majority are able to complete the process with few if any problems. Care must of course be taken when completing the forms and ensuring that any requirement for documents be strictly adhered to thus preventing the possibility of an RFE (Referral For Evidence) request during the process.

Where individual cases are complex through personal situation for example criminal records, visa overstay, medical problems etc then an attorney's advice may be the best option for ensuring a smoother passage through the process. If you are going to employ an attorney then beware as I can personally vouch as can others of the pitfalls than can occur by employing the wrong one. Personally If you require an attorney I would employ one that is affiliated to the AILA (American Immigration Lawyers Association) as I feel you have a better chance of getting the correct advice or service. I do feel you also have a certain element of comeback should there be a problem with the attorney.

Do not be afraid of doing this process yourself as there are indeed many here on visa journey that will do there best to advise you on the correct steps to take. It is not rocket science but still care must be taken in correctly interpreting the forms required.

After talking to people, I paid a flat fee of 1,500 bucks for two people, 750 up front, 750 when they got their green cards plus expenses of 86 bucks for copies and Fedex charges. Sent all evidence e-mail, mostly pfd files that I scanned. Not only filling out all the forms properly, but which forms to use and the easiest way to do it. Was very pleased with his service. But met local people that hired local attorneys, and it was a disaster.

You sure don't want a poor immigration attorney, not only his fee, but the USCIS fees as well. Our attorney sent us the forms and had us fill them out, then he made all of the corrections. This wouldn't be necessary if the USCIS knew how to ask a question using proper English, grammar, and syntax and to phrase the question in such a manner, you know exactly what answer they are looking for. Some of their questions twisted my brain. ####### are they talking about kind of thing.

Looking at my e-mail folder, still on my computer, we exchanged over 200 e-mails, but only talked on the phone a couple or times, giving us a full record of all correspondance and transactions. It was in our contract his office would be responsible for any errors, they did make one on a I-130 they admitted to for my daughter, resubmitted and paid the fee out of that 1,500 bucks and caused a four week delay for her.

There is an American Board of Immigration Attorneys, so if you do run into problems, can report a bad attorney to them, I didn't have to report mine. But all in all with his extensive experience, really helped us through this process. He also reviewed our I-751 and N-400 at no charge, but I had to make the changes.

I ran into bad attorneys with my accident and divorce, reported them all to the Wisconsin Board, even a judge. Doesn't do any good to ###### about this to other people, if you run into a bad attorney, report him/her.

Looks like they do it state by state, didn't know that until now so would report my complaints to the WI bar association.

In my state, fee disputes are not settled by the bar, that's between you and the attorney and the agreement you have signed. With immigration, very routine, would expect a flat fee with guarantees by your attorney, my IA sent me a contract, was in clear plain language, so had no problems with signing it. But when I read a very nebulous contract that requires a second attorney to read it, I walk away, make that run away.
