i) thing is our housemaid(the lady whom we have rented the 2nd floor) she is ok with signing the I-864A and she earns above poverty level, but she has filed for a bankruptcy. So i dnt know if her inclusion wd count or not.

ii) Even if her thing counts i think we have to show the rent to the IRS if we want it to count at the interview. Right ?? OR the I-864A, associated tax returns of the housemaid and the renter contract sheet wd do ? My wife is not ready to show the rent to the IRS right now.

iii) If we cant file for joint tax filing before the interview, wd they accept the tax extension paper ??

iv) Also in the I-864 A what to write for line 8 ( relationship to sponsor ) ? She is just my wife`s friend whom we rented the upper floor.

I wd be thankful for the replies.

June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card

Thanks Motu. No the bills were her own stuff .....nothing to do with the rental unit. So you are saying if we show , atthe interview, that we have filed for an extension, they wont be happy ??

Any idea what kind of tax wd a rent of $600 incurr ?? Thanks ...... those kind of tax organisations charge huge so she might try to go back to her original attorney.

These huge tax organizations charge between $25 to whatever depending on the complexity of your tax return - you can ask them what will it cost before agreeing to do it, otherwise how else are you going to do it? If you are not comfortable with taxes, find a friend who can help you, but my advice is - Do not play this game of not declaring the income on the tax returns and claiming it as income for sponsorship. Also, I don't understand what excuse you have for not filing your taxes? You come across as not 'wanting' to do it - but there is no reason being given 'why'??

Don't be spineless, do your taxes, be truthful and pay your taxes if due - you never know - you may have a refund coming to you - but unless you file, you will never know. Good Luck

Christera22: I understand your situation now. Here's the picture. If your wife is receiving the rent through a check, you people will be in trouble with the IRS if not disclosing the amount. Its just a matter of when. She may have her reasons for not disclosing it and filing for taxes, and the foremost that I see is withholding the hefty amount that would go to taxes. Had she been receiving the rent in cash, it might not have been so bad. Tax evasion here is a major offense. If questioned, especially at the interview, your case might be in jeapordy.

Secondly, your Co-sponsor is no longer a credible one since she herself has filed for bankruptcy. You probably need another sponsor. I didn't know IRS gives you any letter for extension. our H&R BLOCK accountant said, they never acknowledge your request. We never got any. So which tax extension paper are you going to present? You may write a relative(relation), friend etc.
