Hey all, Since my wife got here we visited her sis-in-law. They live in the boondocks and he is very verbaly abusive and won't let her go anywhere and now as they started her AOS(she is on K-3) he is refusing to provide proof of relationship such as bank acct, ect.She is here with her two kids who both have their 10yr grn cards. Anyway,the husband has kicked her out of the house when they argue about needing the proof for AOS. The kids are staying with us for now. How can the Mother adjust status without the other proofs? Does the ongoing abuse come into play? Thanks for any input.

Hey all, Since my wife got here we visited her sis-in-law. Did he really "KICK" her out? Physically "KICK?"

If he hasn't touched her, she has no grounds for abuse. If she wants to claim mental and verbal abuse, as someone here on K-3 visa, she will likely need some witnesses.

(correct me if im wrong)

I'm not. I wish I am. Just my two cents worth. Chill out. It's not the end of the world yet. Who knows?

If you never went thru the divorce process, you have no idea how ugly IT is.

Instead, of "chill out" you can say, "Thanks, maybe I was a bit too hasty."

Just give them a chance to work things out, as we dont have enough info to recommend a divorce.

I think the procedure for K1 and K3 are almost the same for the AOS. After she applied for AOS and her case is tranfered to CSC, she does not need to get those proofs. She would only need proofs if she is required to attend an interview. On her interview, her husband should be with her.

One of the required forms for AOS is the affidavit of support (I-485), signed by her husband. If her husband is not cooperating.. This is a major problem.

I heard of filipinas that were abused but able to adjust status on there own. Bust she needs proof that she was/is abused.

As long as the beneficiary is here, I think the I-134 and the I-864 mean what they were intended to mean. The beneficiary can not become a public charge.

I just like warning about thinking about pulling out the "abuse" card, because in order to use the abuse card, abuse has to be well documented with more than just the sis-in-law.

If worst comes to worst, and the husband has no interest in filing 'jointly' the removal of conditional status - your sister (or your wife's sister-in-law? whatever) can file independently if they divorce. If she's verbally and physically abused by her hubby, she must establish then, as a battered wife - then file on its own. Read more on the USCIS guidelines.

And if she's a Filipina, and is planning to remarry, and is planning of keeping her Fil citizenship - tell him that her husband MUST initiate the filing of divorce.

Last but not the least, get a lawyer!

Let's pray for these people. It is very sad. Surely the husband loves her in spite of his angry temper, and she loves him, or else they never would have come together. Sounds like the husband needs an anger management program. I am going to check about it.

In Texas there is this link to Celebrate Recovery. http://www.celebraterecovery.com/?page_id=97 It is a Christ-centered program, totally awsome. They also have groups for anger management. I know about this because I was a drug addict, and Celebrate Recovery was very important in my recovery at that time. Their anger management groups sure help a lot of people.

If they live elsewhere than in Texas, please let me know and I will help you find a place close to them. I care.

Can you provide more background information on their relationship up to this point in order for people to be able to properly comment on this? maybe he has reason to be acting this way due to her actions? maybe not but we do not know enough to comment.
