Why do you expect or think you deserve amnesty? It is not fair to all of us that immigratred the legal way and paid our dues with the long painful process.

When he came here he knew he was doing something illegal and a federal crime so IMO he needs to leave and you can try and go the K-1 route or you visit his country and marry him there and go the K-3 route.

I can't comment much on your situation because you have problems to address that I haven't studied much about. Off hand, I can't think of any way to resolve this without him either receiving a ban, or you having to lie substantially on the petition (which could land you in jail).

However, I will say that I wouldn't hold my breath for an amnesty program in the very near future. In this economic environment, giving legal status to illegal immigrants is not a politically popular move. People don't like the idea that there are illegal immigrants working in this country when unemployment is already very high for people who are here legally.

If and when Obama's immigration reforms DO happen, there are a few things you can expect. First, the penalty for hiring illegal immigrants is going to get a lot stiffer. Second, immigrants who are here illegally are going to have to pay a substantial fine in order to seek legal status. The fine will probably be based on the length of time they've been here illegally. In the case of EWI immigrants, that length of time may end up being determined by when they can prove they were last in their home country, and not on their own statements. Otherwise, people who've been here a decade are going to say they arrived just before the cutoff date.

I understand your concerns and sympathy for the economic conditions of your fiance's home country. Many of us have the same concerns about our fiance(e)'s, but we are trying to help them in their own countries while trying to bring them to the US legally. Many people here are going to be offended by your desire to work an "end run" to legalize your illegal fiance, while they've played according to the rule book and have endured months, and sometimes years of separation from their own fiance(e)'s.

My recommendation is if your fiance entered without inspection, he can probably leave the same way. Have him go home to Guatemala, and then file for a petition to bring him here on a legal visa. Be honest about his illegal stay in the US, and file for a waiver along with the petition.

Yes, definitely wait for Obama to save you. He will get around to saving all of us. He is busy saving banks and auto manufacturing right now, but he will get to you. Don't worry.

Are you freaking kidding me??!! Sorry but gotta ask... what makes everyone think that Obama is some kind of savior? Is anyone paying attention?? He is just continuing the destruction Bush started, but even worse. He is leading this country right down the drain. With what he is doing we are going to see huge tax increases, which have already been started by what Bush let congress do. Now Obama hires a Pay Zar to control how much CEO's get paid! Sure they probably get way too much but why not hire one to control how much congress is spending, or how much it costs to hire a new federal agent (millions).

Sorry for my rant but I just get sick to my stomach when I hear someone say Obama is going to save us... barff

Anyway... Obama's talk of amnesty was just one way to get votes and he sure got them. There's no guarantee that the amnesty bill will pass anyway but if it does read it... there are all kinds of fees that illegals will have to pay like someone posted above... I read $5,000.

My heart goes out to you for having to go through this. I can't imagine how hard it is. I wish I had an answer that would help. All I can do is wish that this process was made easier for those people trying and wanting to be legal, since most people trying to be legal are just good hard working people.

He is just continuing the destruction Bush started, but even worse. He is leading this country right down the drain. Um... there's this little word called "sarcasm". You might want to look it up in this book we call a "dictionary". Look into it! I can fully well assure you that Gary was being sarcastic about Obama saving the OP (or anyone).

I, on the other hand, fully believe in Obama's Salvation and believe that the He :innocent: has now Arisen. At any moment now I expect to be personally saved. So too should you! :P

Ok, Ok, sorry :crying: I admit I went a little nuts last night. I was extremely tired from going through all the AOS papers and was just getting so angry with the whole process, so when I read that little line I took it too seriously. Last night "sarcasm" was non existent in my brain.

Hi!

Well I was kind of in the same situation as your fiance. I illegally came to the US as an infant. I got married to my now husband in california 2 1/2 yrs ago. And we started the process in january 09. We hired a lawyer in san francisco and have filed for an immigrant visa for a spouse (CR-1). I was told that I would have to leave the country and go back to Guatemala when I received my interview date but I could stay here until then. I also have had jobs in the US, filed taxes, have a bank account etc. Once I have receive a letter with my interview date I will go back and have to file a waiver and request a pardon for unlawful presence in the US. My lawyer said this process will take anywhere from 1-6 months. After I receive my pardon I can re-enter the US. So it is possible to start the process and even get married in the US. I would suggest looking up immigration lawyers in your area and setting up an appointment with them. They will let you know what your options are. It is a little more money to hire a lawyer but I found it to be extremely helpful. Good luck and I hope you find this helpful.
