Question to Canucks about EAD?

its been almost a month since USCIS received my application I765. I didnt file my adjustment at the same time. we are doing that at a later date.

but its been a month since they received my I765 and my NOA1 and arent I suppose to get a biometrics interview?

Should be any day - have you checked out timelines in the other forum for your service centre?

I checked the VJ timeline. most of the service centers are Chicago and mine is California. they are being approved faster in most cases than mine.

the California processing times on USCIS is 3 months. So I still have 2 more months max to go. But based on VJ timeline, everyone is getting their biometrics interview 3 weeks after they received their NOA. (but then again, most people's I-765 was submitted with adjustment). that's not my case.

I was always under the impression that you couldn't file for EAD or AP before your AOS. Perhaps its different for K-3's...

It is different for K-3s. If you don't hear anything a full month after your NOA, you can certainly try calling the 1-800 'Misinformation line" and seeing if they can give you more information. Try to escalate the call to an actual immigration officer - that is not the person who answers the phone. The phone lines are manned by call center employees who read off of scripts. Hopefully you will get your biometrics appointment soon.

I thought district offices processed standalone EADs and not the service centres?

Well I looked at the one in Yakima and Seattle in WAshington. they had a notice on their website that they no longer process EAD applications at their locations. bummer for me.

but i called California service centre and i talked to an agent. She put a request for biometrics appointment for me b/c i shouldve had one 3 wks - 1 month after receiving my NOA. however, she couldnt give me a timeframe of when I was going to get a notice. double bummer. she said they are back logged w/ cases. so who knows. i wish i just adjusted my status right away. i live and i learn.

Shouldn't be long. I submitted for everything in November, got the NOA1 in December, got the biometrics notice in January, Got the card in February.

so its been almost 2 months that I havent heard anything about biometrics. I have already put a call to USCIS in California telling them that I still do not have an interview for biometrics or havent heard about my EAD. A week later they sent me this:

I want to follow up on this but I know USCIS is useless and will give me the a paper read answer. VJ timeline suggestion says I should call them on Monday.

If you are close enough to a USCIS office I would actually make an infopass appointment and go in person to speak to an immigration officer. It may even be possible for them to send you for biometrics at the same time ('may' be possible - no guarantees). You should have had something by now, yes. You can make an appointment online at http://www.uscis.gov . On the right hand side you will see a column with options - select Schedule an Appointment and then follow the instructions. Good luck.

Levi's biometrics was over two months after the NOA. We called and asked what was going on and shortly after he finally received the appointment letter. Never really got an answer on the reason for the hold up. The good thing is he was approved as soon as the appointment was done. Good luck

ok i tried the infopass appointment but the only option it gives me for EAD is to book an appointment only if it has been over 90 days since hearing from USCIS. Its only been about 60 days since my NOA1 so I guess I will wait it out. Hopefully my situation is like Levi's. Im just worried b/c I havent received anything about biometrics appointment. And when I called USCIS about a biometrics appointment, the email I have copy & pasted was their response. The agent on the phone says I will hear from them within 30 days and its almost 30 days. You would think they will give you enough time to be advised of your appointment. My 90 days will be the first week of August.

Any fees are already included up front in the application fee. You don't need to take any money with you. Biometrics is actually pretty straightforward. You arrive, 'sign in' with the guard who checks your letter and your identification then gives you a form to fill out. You then take your form to a central counter where someone checks over the information and hands you a number. Then you go and sit and wait until your number is called. Usually you don't have to wait very long. They will digitally take your fingerprints and your photograph, then that is it. I'm glad to see you finally got your appointment. If you have a SSN make sure you have the number with you - don't need the card - because there is a place for it on the form.
