So, I used to frequent a website of an "Immigration Lawyer" initials, R.G. His website hardly generates any answers so I moved on...and found VJ.

Anyway, I decided to check it out today...curious if it ever picked up any kind of flow. Someone on there asked him if he should go K1 or K3 to be with his fiance as soon as possible. The LAWYER answered that he recommends the guy to bring his fiance here on a visit and marry her, then file an AOS. #######? I mean, I know it is possible (though not legal), but the risk of a 5 yr+ ban is too great! How irresponsible is this guy?

It is illegal, and all of us that have done it the right way will probably fume at such a suggestion coming from a lawyer. But! When you see how much ####### all of us have to go through for a simple thing like uniting with your fiancee or spouse - man, I can't say I blame these people too much. Waiting for half year or more to be with someone - that is a hard test on any person and any relationship.

Of course, you do risk a ban when circuimventing the system, so...

No, I don't blame the people for thinking about taking that risk. Actually my fiance and I thought about it too...was even recommended by the USCIS call center AND my local congressman. However, upon doing more research we decided the risk was too great.

My issue isn't with the person asking the question, it is with the self described immigration attny suggesting this. He is suggesting something that is illegal and risky. I think many people trust attnys to give them the best answers for their given expertise. To me, this is completely irresponsible advise to give someone who is searching for the right answer.

Doesn't surprise me. Attorneys are interested in $$$$ He will gladly represent the person he gave the advice to and collect his money and do nothing. He typically has to spend a few minutes reveiwing what his secretary did for a K-1 for only a couple thousand.

Immigration lawyers for the most part are like tapeworms.

We are not using a lawyer...we are doing this on our own. However, I just think if you are going to put yourself in the position of "legal expert", you should avoid giving out advise that goes against the law, and your client's best interest (especially if the USCIS finds you out and your fiance is banned).

Oh. I am gonna stay here for sure! :yes: BUT, I might go back there too and post that question. Chances are he will delete the post though. His whole website is all about the immigration laws and what changes there are and so forth. However, if this is his answer to an inquiry...I wouldn't trust him as far as I could throw him.

No I did not. I will not pay lots of money to have a lawyer's secretary fill in simple forms with information I provide. What do you call a fair fee for a secretary filling out an I-129f and G-325 (with information already provided to them by the petitioner) and putting the documents the petitioner provides in an envelope and mailing it? $25? $50 tops? Don't forget you still need to run around and gather all the information and documents for them, THEY don't have it. It isn't even a "legal process". The forms are no more complicated than a job application to Lowe's or Walmart. You need an attorney for that?

I would recommend a visa service if you need a professional, they usually have translators and people to communicate with your fiancee in his/her language. At least they are equipped to provide service.

I had an immigration lawyer that claimed over 10k successful K visas on his website. I paid him $1800 and he made no less than 10 mistakes, and also delayed my case for a minimum 3 months. Getting a live person on the phone, or for that matter a return email or phone call was impossible. Thanks to this website I corrected his mistakes. My wife received 221g at her interview, and he disappeared. An attorney can not speed up your case. By the nature of the USPS, or express messenger services, it WILL slow your case down. You still have to collect all the documents and send them to the attorney. This in itself is a delay that can not be avoided, no matter how good the attorney is.

Disclaimer... I am in no way advising, or not advising someone to use an attorney in this process. This is just what happened to me.

I would also be interested to see the website.

Immigration for Lawyers is big bucks for doing very little, you gather everything give them all the information and all they do is fill in the forms (wrongly) and wait for USCIS to adjudicate.

I agree the forms are simple we managed to get ours approved with no RFE in good time.

In my scramble for information, I emailed anyone that claimed to be an immigration lawyer in my area, sent something like

15 emails to different firms, of those, 10 wanted an initial consultation, (charging between $100 and $300), these I ignored.

1 said he doesn't accept unsolicited emails, and 3 offered some legal advice, all of whom turned out to be wrong. I also sent

emails to the State Department help email address and the concerned Consulate, yet to hear back from either. VJ has so far

been the most useful resource, able to give clear answers for free. IMO, VJ wins.

Happily married, waiting to file to remove conditions on permanent residence in next 2 years.
