Hey guys, I just received a checklist from NVC sent to me & our lawyer for missing documents for the I864 filed. There's a phrase that has me worried. They have listed the missing items as information of the principal immigrant & accompanying dependents, W-2 forms missing and signing to be in blue/black ink. The phrase that has me worried is " the documents submitted are incomplete and as it stands the petitioner does not meet minimum income requirement. The consular officer will make a decision regarding this requirement at the time of your interview" Does this mean that according to NVC my husband is below the poverty line? As the principal immigrant what forms are they expecting from me, i do not have any acy companying dependents? Does the visa approval come from NVC or the interview?

Someone help, I am abt to lose my mind, the lawyer says we are above the poverty line but NVC says something else, I am very confused & heartbroken.

Have you checked the poverty guidelines? Here is the link: http://www.uscis.gov/files/form/I-864P.pdf

If not, you will need to get a cosponsor.

How much income was listed on the 864?

How many people is your husband responsible for? (what number would you put down on the 864?)

Without the w-2's, they cannot prove your income is sufficient. The wording sounds like a general "boilerplate" statement, so if you provide the missing evidence, you should be ok (as long as your husband has enough income to meet the poverty level for 2009)

I take it you don't live in Alaska, or Hawaii, nor is your husband in the military - so you would need (if it's just you and him) - $18,212.00 - so, is his income at or above this level? (remember - only counting 2 people)

Hey guys, Thanks for the responses. I feel like such an idiot now. Yesterday as i was going thru the checklist i thought every item on the 6 paged document needed to be resubmitted. Apparently all that is needed are the items actually checked out. And its just one item that was checked out, Letter from employer. My husband makes more than 80k anually plus the real estate assets listed indicate we do not need a cosponsor - thank God. English is indeed a second language for me and the long wait hinders my comprehension. Our lawyer has submitted the employment letter and the ball is rolling again. I will be so happy when its all over. Thanks again

Help! Hi to everyone who can help me with this: NVC received the AOS on july 06 2009 with the 3 most recent tax returns, and completed the case on July 11 2009, but my husband received today a checklist dated on july 14 saying this:

We have reviewed the documents which you submitted in support of an application for an immigrant

visa. Please review the information listed under each applicant's name and provide any documents

which are indicated as missing or need additional information. You must submit the required

information. Failure to provide the requested information will delay your immigrant visa interview.

may wish to submit an additional Affidavit of Support (Form I-864) for a

Joint Sponsor to the National Visa Center to assist in sponsoring the

If you decide to use a Joint Sponsor to assist in sponsoring the intending

immigrants, please note that you the sponsor may not use Form I-864EZ

My husban didnt include property because his cash met the minimum income requirement, and as it says at AOS instructions, should be asets easily converted to cash plus he neded to make an apraisal for the property and that might take some time. I dont understand why they said he didnt met the income requirement.

Can we submit the apraisal and add the property information before they mail the case to the embassy, we wouldnt like they take this issue as negative at the time of the interview.

Or do we really need a joint sponsor even if he met the income requirement ?

What should we do?
