Hi i am at the very beinging of th K-1 process . My fiance lives in Jamaica and i live in the US i just gave birth to our son 4 weeks ago . I am currently unemployed I previously work as a flight attendant for US Airways . Now due to my finacial hardship due to not working i would like to apply for a fee wavier can i get some help or some much needed info on fee waviers espacially what i should write in the fee wavier letter please help......................

Unfortunately you have a considerably larger issue with which to deal than paying the initial petition filing fee. You, or you and a co-sponsor must sign an affidavit of support for your foreign fiance in order to sponsor his immigration to the USA. It's unlikely a visa would be approved based on such sponsorship, if the sponsoring parties were unable or unwilling to provide the immigration related fees. The whole idea of the required sponsorship is to assure the government, your fiance won't become a public charge. Beginning the process requesting the filing fee be waived is likely to doom your later attempts to show adequate financial sponsorship.

Fee waivers are generally not available for the I-129F because of the "public charge" provision at the application stage. Fee waivers are sometimes available for the I-485 you file for AOS, but only in cases where the "public charge" provision does not apply, such as asylum cases. You can try submitting a fee waiver application, but expect it to be denied.

The "public charge" provision is a requirement that you, the sponsor of your foreign fiance, must demonstrate that he will not become a "public charge" (i.e., receive means-tested benefits like welfare or food stamps) after he arrives in the US. In order to do this, you generally have a to file a form (I-134 or I-864) along with evidence that you have income which is at least 125% of the poverty level for the size of your household. This is submitted by your fiance when he interviews for the visa. For you, your son, and your fiance, this would be $22,887. If you can't meet this requirement, then you'll need a cosponsor who can. You need to submit this evidence with his visa application, and again when you apply for adjustment of status after he's in the US and you're married.

It doesn't do much good to plead poverty with USCIS when you're applying for a visa for which poverty will disqualify you.

Herein lies the problem. You are applying for a visa that requires you to provide financial support for the intending immigrant and you are asking to have the $455 fee waived because you cannot afford it. You understand there is another $1010 fee when he arrives and you are married, yes? And that you must provide financial support affidavits TWICE, correct? Not somewhere I would want to go with this kind of visa, but you are free to ask and bear the future consequences.
