I upgraded my wifes petition last year December 08, no decision yet. Can i take them to court, I am getting impatient ... after 4 years of marriage my life is being destroyed by this process of waiting.

that will get you started.. and I have more too.. but I think you still need to wait a bit.. normally it takes 6-8 months.. waiting about twice that will net you a lawsuit complaint (also known as "writ of mandamus")..

I know individuals who are filing and have a greencard it can take a while, but 4 years is a long time...Have you tried calling USCIS? did they say anything?

There's your answer...and unfortunately there's not much more you can do until those checks are completed. Who is it you want to take to court, the US government? Remember that having your wife emigrate to the US is not a constitutionally provided right, it is a privilege of sorts, extended to you as a US citizen/resident.

background check my ####.. that's what I think.. we have been through it and if you just sit there doing nothing, they will do nothing..

1st step - write to all (not just yours) senators, congressmen, White House, any government department relating to USCIS (FBI, Dept of Justice, Dept of State).. White House (including president, first lady, vice president, his wife, secretary of state, chief of staff, whoever you can find)..

2nd step - I got letter from FBI stating I DIDN'T have security checks on my case.. so I used that in my "writ of mandamus" lawsuit.. so you need to prepare for that too.. it is best to hire a lawyer for this part.. they will write a big package stating everything.. and the USCIS will get 30 days (with 30 days extension), a total of 60 days to respond with answer.. the lawsuit isn't for money, just to force them to give answer.. we got approved on the 58th day last time and we plan on doing it again..

we have been through a lot more than others.. the different types of stuff they can throw at you.. "local office interview" too.. everything is messed up with them..

Also, most FBI checks take no more than 72 hours.. it even says on their website.. so anything over a week is because USCIS is stupid and retarded.. :angry:

Electronic “batch” submissions are searched against the UNI. The majority of the batch names are electronically returned as “no record” with 48-72 hours.

I just wrote my whole story to them this morning.. asking if our case has another "name check" and if it was real this time.. our 2nd name check happened after the interview.. that's why we are not approved yet.. read my story for more info, but they said it was "ready to issue" but at the last moment, there was a name "hit" again..

yes, some will take more than a week.. but even with us the first time (6+ months).. from November 2007 (transfer to local office), to our local office interview (February 2008), and more.. it doesn't take that long.. give me a break.. even now we are over 2 months already.. it should be about time..

haha, well what I write isn't.. :thumbs: but I know the USCIS is.. how long does it take to do a background check in the computer?.. no more than a couple of minutes if their software is up-to-date.. search "name", "ssn", and other stuff.. that is all they are basing it off anyway when you do a FOIA request.. they just want your name, fingerprints (proof of identity), and a fee.. and people in China (my wife) have their own passport too, and "huokobun" (China ID), so how hard is it?? :angry:

oh, sorry.. just had lunch.. you give them your info on BOTH PEOPLE :

1) FIRST NAME + LAST NAME

2) A # if you have both, but probably just the US Citizen

3) Case Number

4) Email addresses (both)..

I put both for everything.. anything else that can help.. in China, she has a China Passport ID number.. I also put down my home phone and cell phone.. maybe it's too much, but I just want to get her here.. besides, the FBI probably has all that info already.. :thumbs:

I just sent it this morning, so probably not expecting anything for at least a month or two..
