Here is my story. My husband has a 2yr old little boy from a previous relationship.He was able to see his baby cause he was stationed in the same place abroad as the mom (they were both military),but when they moved back to the states they moved to 2different states and thats when the craziness started! She always promise to let him see the baby but she change her mind at the very last second. One time my hubby made a trip all the way to Seattle (we live in mo) to go get the baby and she attacked him at the airport yellin that he was kidnapping the baby (he even had to go to the hospital cause he was bleeding from her bite!!).Last time he supposed to go get the baby for 6 months cause she was going deployed and she didnt show up at the airport.She didnt care to let us know where the baby was either.

Tired of dealing with her we went to a lawyer to file custody for the baby (or at least some visitation!!)and thats what the lawyer said:

-We cant file for custody in our state we gotta go the state where the baby reside now and find a lawyer over there (and we dont have that kind of money)

-He doesnt have any rights cause they never been married and untill a judge order a DNA test he is not the father (even if he signed the birth certificate)

He was paying child support without a court order but he stopped when she went deployed cause we dont know where she is or where the baby is( we think he is with her parents).

Im worried for this little boy and of course for my hubby! Do You guys have any advice? Do you know if its possible for me to find a lawyer in Missouri that practice even in Cali?

omg what a nightmare for you :(

I can't really offer any advice - I don't know enough about the law in this regard in the US..just wanted to say I hope you can get it resolved.

I am assuming from your post that your husband is no longer with the military cos if he was they have legal advisors on post usually that can help.

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

If you don't know where the baby is, how can you find a lawyer licensed to practice in the state of the babys residence? Seeing how you don't even know (but only suspect) which state that is. Did you ask your lawyer this?

Yes the lawyer said the baby residence is in the state where she legally reside which is California. :unsure:

Is your fiance and the mother of his child still in the military? He could get in touch with the Family Service Center and see where she is now based and then file appropriate legal paperwork for visitation.

It is hard when a mother decides that she doesn't want the father of her baby to have visitation, but without a DNA test to prove he is the father he has very few legal rights.

She is still in the military and he is out. We tryed to contact her but she is on a ship somewhere and she will come back in september. We even tried to contact her parents but they dont answer the phone and never return any calls. She doesnt want my hubby to see the kid but she SURE TOOK all the money we sent for child support. Im worried cause now he talks about being a check in the mail dad. Thats sad poor little boy!
