I'm a USC and my wife is a UK national. We've been married for over three years and have a soon to be one year old daughter. I've been in the UK and have my permanent residency, ILR. We are wanting to move back to the US and from what I can tell, a Direct Consular Filing seems to be the best way to go. Can someone confirm that for me?

Also, will a letter from an employer stating that I have a job that I'm coming into work to support my I-864 or do I need to have started a job?

As long as you have lived in the UK for more than 6 months, yes you can DCF. As for the job stuff, I am not sure about.

15-July-2009----SMS Collected Documents

17-July-2009----Delivered to Embassy

21-July-2009----Visa Processed/Put in Passport

23-July-2009----Visa Delivered

23-July-2009----Husband does the "I have a VISA" happy dance!!

26-July-2009-----Holiday in Wales for 2 weeks.

Sounds good~ But you need to make sure you have kept things in the states up to date, such as a valid drivers license, voter records, tax records, perhaps an apartment or home there or at least a US address where you still receive mail, etc...This is all needed for the 'domicile' issue that comes up in DCF cases. If you are not currently receiving income from a US source that will continue after you move to the states you will need a co-sponsor unless you have enough assets to meet the requirements. The Guide at the top of this forum and the forms will be most helpful!

April 29 2009 - Received VISA in mail!

June 22 2009 - Flew to NY

Sept 18 2009 - Moved to NC-WooHoo!
