NSO Birth Certificate - NEED HELP/ADVICE PLEASE!!!

Hello fellow applicants! I have a question regarding NSO Birth Certificate...

Do you have to have an authenticated Birth Certificate from the NSO? The problem is that my husband's NSO birth certificate is erroneous.. (last name and birth of place is incorrect) and we were told that we have to file some sort of a court order to fix it and it might take 6 months to one year (some might take even years and years to complete)...

As of right now, we are still waiting for our DS 230 to get approved... We used an autheticated copy from the city/municipality. Just so you guys know, that same birth certificate is what we used to obtain our marriage license and we have not received any RFE's from USCIS or NVC with regards to this issue... HOWEVER, it might not be the case on the actual interview... so please, let me know what you guys think.. any advice would be very much appreciated. Thanks in advance and God bless us all!

Is your authenticated BC from the city registrar correct? but the NSO copy isnt? Yes you need to submit a NSO copy of your BC for the DS-230 and the original on the interview. I heard it could take awhile to make some corrections on your BC. I suggest you go to your respective city registrar office and have it fix, comply all their requirements which i think includes affidavit of 2 disinterested person and i heard you need to publish it to the newspaper and when you comply all the requirements request for a priority forwarding to the NSO main office. You would rather do it now than face complications in the future with regards to your immigration papers.

You definitely need an authenticated NSO copy of your husband's BC for the interview. The Embassy will not accept the authenticated copy from the city/municipality.

You need to apply for "Correction of entry"... since you have mentioned that you already have an "authenticated" copy from your local civil registrar, then ask your local civil registrar for correction of entry. Bring a copy of the "authenticated" document, copy of other supplemental documents bearing his "real" name (or what he is using), a copy of his baptismal certificate (if that one have the name he is using and much better supplemental document if this is also done in the place where he was born). The usual fee for correction of entry is about P1500.00 (unless they have changed it from the time I left the Philippines). This usually takes about 3-4 weeks to process at the LCR level, since there is also the procedure of publishing this request at the local newspaper for 2 weeks, etc...

Once done at the LCR level, they will send you a copy of the "corrected" document. Have the LCR send an endorsement right away to NSO, you will be paying for this of course and you will also receive a copy of this. After NSO received their copy of endorsement, you will have to follow it up at NSO, and apply for an authenticated corrected/annotated copy of your BC. Make sure you bring your copy from the LCR and the copy of the "endorsement letter" that LCR sent to NSO. At NSO, they may have it right then and there or they may ask you to return after 2 weeks. In my case, I was asked to return in 2 weeks, while there, I applied to get 5 copies, so I don't have to go back there to get the "corrected/Annotated" copy of my BC.

There maybe some changes of the process of applying for "correction of entry" from the time I left the Philippines, you need to check this at your LCR. Hope this info helps and Good Luck.

have it corrected as soon as possible to avoid future delays. When I noticed an error in our MC, I directly went to the registrar, was interviewed, paid and waited for such time... I have done it while waiting for our USCIS approval. I don't want any delays while already on the process or even during the interview.

We were told (by some individuals) that the correction of entry is not applicable in our case because there are too many incorrect letters... (His place of birth for instance...) But i will definitely forward this info to my husband... Thank you very very much! I guess we have no choice but to go through this painstakingly process of correction :( I was hoping that there's another way around because it will take sometime but I guess there's none...
