Changing first name on AOS packet

Timeline

Hi everyone. I need your advice on this.

I filed my wife's AOS package w/ her new American name (first name). Would this cause an issue down the road? i.e. FBI background check, etc.

USCIS sent an NOA and she has her biometrics scheduled for 6/10/2009 w/ her new American name. I'm not sure if we should mention it to the person and correct it to her original name or is it okay to go with her new American name? I'm a little puzzled...

07/03/2008: I-129f sent via USPS

07/07/2008: I-129f received at CSC

07/22/2008: NOA-1 issued

11/11/2008: Touched

11/14/2008: Touched

11/14/2008: NOA-2 Approved

11/20/2008: NVC Received

11/21/2008: NVC Approved and sent to Embassy

11/24/2008: Embassy Received

12/15:2008: Medical Exam

01/22/2009: Interview - K-1 Visa Approved

01/28/2009: Visa Received

03/01/2009: POE (San Francisco, CA)

04/18/2009: Court Marriage (Chicago, IL)

05/13/2009: AOS Package sent via USPS

If her new name is legal, then no issues.

Also, most forms ask for the "maiden" name, for just such occurrences.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

02/05/00 - Relationship started

09/08/06 - Engaged & Pregnant!

03/13/08 - I filed for Citizenship

07/22/08 - Became US Citizen

08/02/08 - I-129F sent

08/13/08 - Case received by VSC

08/16/08 - NOA1

08/18/08 - Touched

12/18/08 - Touched again exactly 4 mos. after 1st touch!

12/18/08 - Noa2 @ 3PM-Gracias Dios Mio!

12/24/08 - NVC sent pckg. 3 to Embassy

01/02/09 - Pckg 3 rcvd. by Embassy

01/09/09 - Pckg 3 from Embassy received by beneficiary

02/09/09 - Medical exam

02/16/09 - Sent back checklist and docs required by embassy.

03/13/09 - We will fly to see Daddy Gary

03/16/09 - 1 PM Interview (Pray God he gets visa)

03/16/09 - 5PM INTERVIEW PASSED WOOHOO. Thank God.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

I don´t need patience if I have love. Ah I que Viva mi Guayaquil Carajo!

I took it that the OP meant "new last name" (first name) - but I could be wrong :whistle:

I won't comment on the "american" part of that :innocent:

Oh - that is different then (sorry for the info above - I took it you meant the "last name").

She should use the name that is on her passport (since that is the last legal one she used) - she would have to go through some legal process to change the first and last name.

Marriage usually changes the last name, not the first one.

Just to clarify for others who may come along. Putting a different name on AOS forms doesn't legally change a persons name (in other words it is not the way one would go about legally changing their name).

For last/family names - in the case of marriage - most states allow the person (usually the woman) to change her last name by means of the marriage license/certificate (not all states) - once the certificate is 'recorded' the person may then obtain a new DL and SS-card in the new name. And it is perfectly fine to use this 'new' last name on all AOS/EAD/AP forms so those documents will eventually be issued in the new name.

First name changes vary - I don't believe it is commonly done with the use of a marriage certificate so there is likely some other court-related method. If you did not legally change the first name - you should reconsider changing/Americanizing the first name on AOS/EAD documents. I wouldn't even consider doing such a thing.

I think the OP means that his wife took her Korean first name and changed it to the American equivalent on the forms.

For example, if my first name was "Pedro", I COULDN'T use "Peter" on my AOS (or any others document) because your first name is your name unless changed legally, no matter what country.

You can use it as a nickname that family and friends call you, but not on official documents.

She will most likely have the AOS rejected or get RFE about name.
