Timeline

Have a friend in Peru that is intersted in an American man. Problem is her sister entered the US on a tourist visa 7 years ago and never left.

What would my friend's chances of getting a K-1 visa in the future??

Would she be rejected becasue of her sister?

from what i have read on this forum one of the questions is do u have any family in the usa?

im not really sure if it would come back to biter her because she is trying to do it the legal way, im sure someone will come with a better answer than i have given u but i really dont think it will have any effect on her own k1 visa

I think it's consulate specific, and would depend on whether they know about her sister. Someone recently posted on this forum about their Filipino fiancee getting raked over the coals by the CO because of a similar situation - family member was in the US illegally or involved in visa fraud. Apparently, the Filipino fiancee was repeatedly accused by the CO of being a liar and a fraud. I don't know if the same thing would happen in Peru.

They DO often ask for a list of family members in the US. It would be excusable if you "neglected" to list an uncle or second cousin because you could just say you didn't know about them, but it would be difficult to say you didn't know your own sister was in the US. If they ask for the list, and the sister is not listed, and they know about the sister from other sources, that would probably be the end of that application - the package would be sent back to USCIS.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

I have no experience in this problem, but I would recommend that your friend accumulate alot of evidence to prove the relationship is real. I strongly recommend your friends fiancee attend the interview with her. The embassy has a habit of knowing more then we would like and most likely they will give her a hard time.
