my wife I-130 is approved with her mothers middle intial bcz my attorney made a mistake and did not use her fathers intial

now in philippines she can not get NBI, CFO or cenomar bcz they want to use her fathers initial as a middle name

any advise please help

what can she do to get all the things with the same name which is her visa issued

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

In the Philippines, we use our father's last name as our middle name once we get married...and i don't think you can change that rule. So if i were you i will try to contact the USCIS and ask if you can send a corrected I-130 with the correct middle name of your wife and maybe a letter to explain the correction. But if your petition is already at the NVC call them and ask them if you can change it. This is the only thing i can think of, maybe others who have been through this can give u a better advice. :)

as your petition is approved ..so ur all calls and help will be with NVC ..

if u r there or whenever you are there and got ur case number please talk to an operator and ask for the change ...

USCIS is out of the Game as long as u r approved as u state

I'm assuming your attorney is your "agent" (individual that deals with correspondence between you and the nvc) right?

I would have your attorney call up the NVC to clear up this biographical error and have the NVC change your wife's middle name reflecting her father's last name (family name).

Did your wife also change her name on her passport to reflect the proper info?

The visa that is issued will reflect that biographic info on her passport as well as the info on the DS230.

8/22/2008 Received NOA1 letter

1/28/2009 Received e-mail update from USCIS-Petition Approval!!! Official letter still in mail.

1/29/09 Received Official NOA2 Letter

2/10/09 Received Case number from NVC

2/11/09 Paid AOS Bill

2/12/09 AOS Bill marked as PAID

2/19/09 My wife sent DS3032 to NVC via FedEx

2/23/09 NVC Received DS3032

3/02/09 I864 AOS package sent to NVC via Express Mail

3/02/09 IV Bill Generated

3/04/09 NVC Received AOS package.

3/06/09 Paid IV Bill Online

3/09/09 IV Bill Marked as PAID online

3/12/09 I864 Package is Incomplete and/or missing some items.

NVC mailed info on 3/12/09 on what info is needed. Awaiting to receive letter.

3/23/09 Sent DS230 package to NVC via USPS Express Mail

3/24/09 NVC Received DS230 packet. The item was signed for by R AUSTIN.

3/31/09 NVC Case Completed

4/21/09 Case Forwarded to US Embassy in Manila Philippines.

4/24/09 US Embassy received case

***Awaiting Interview Date on May 26, 2009***

5/07/09 &

5/08/09 My wife passed medical

5/26/09 My wife passed her Interview, Visa Approved (I am soo proud of her)

5/30/09 Visa in hand

10/24/09 Our Church wedding

Hey i hired attorney to get file my I-130 and she put her moms initial in the middle and now i am stuck with this

i got the case number and i filed I-864 already and now i am doing DS-230 but my wife can not get NBI, or CENOMAR or CFO with her moms name in the middle. so i am stuck here and my wife can not get papers there. i dont know what can we do?

her passport is still in her maiden name she did not change it yet and she has philippines id with her moms intial,

she tried but still no sucessful and i am waiting for her to send me NBI and cenomar so i can file her DS-230

Your wife needs to get her NBI and Cenomar in the name that she has in her birth certificate, and her id's. That you made a mistake in filling out the I-130 is secondary. The police and other such clearances will only be valid if they are issued to your your wife bearing her official name. The correction of the middle name to reflect the correct one can be done w/ the actual visa application, at the consulate.
