We are getting ready to file the K-1 application, but only have the Court Decision on Annulment. Should we wait another 2 or 3 weeks till we have the Finality (Decree) and include it also with Application or is it not necessary to have the Finality till the Interview. We have been waiting over 16 months for this and would like to go ahead and file. We just need some accurate advise.

You need copies of the Decision and Finality to file I-129f. You might get RFE(request for evidence) later on if you will only include the Decision and it will delay the processing of your petition.

hi, my fiance attached a photocopy of annulment court decision when he filed for I-129F in january 2009 and we got the approval in april (our RFE was for photos, not for the annulment papers). i will make sure to bring all the other necessary annulment papers e.g. annulment decree/finality and the annotated marriage cert from NSO on my interview this coming thursday. i've read here same experiences and so far the petition were approved. just make sure to let her bring all the more important annulment papers and other requirements for her interview. good luck and God bless.
