On my Declaration of Nullity I was awarded soul custody. Do I need his fathers written permission to leave country with him. I heard they like a letter but its not required if I cannot get one. Anyone have this experience?

I am not sure about the Philippines law,

but in the US...in my state, The parent has to notify the other biological parent if going anywhere outside of the state, at least 7 days in advance. Because is written in our divorce decree by the judge.

If you are located in the Phil, maybe someone locally can give better advice.

I do not have full custody of my daughter. You do not need written permission from the father or DSWD clearance. You just need the NSO birth certificate of the child to show at the immigration in NAIA.

05/18/07 married

05/29/07 sent I-130s for me & my daughter at CSC

06/16/07 checks for I-130 cashed

06/19/07 sent I-129F not waiting for noa1 but with printed online copies of checks cashed

06/25/07 check for I-129f cashed

06/29/07 transferred I-129f to CSC

07/03/07 received noa1 in the mail for I-129f

10/31/07 approved K3 and my I-130 except for my daughter

11/05/07 received NOA2 in the mail

12/01/07 received mail from NVC/yey we got our case number

12/20/07 went to St. Lukes and had my early medical exam

01/30/08 schedule for medical

02/07/08 interview, approved!

02/12/08 visa pick-up/cfo

02/14/08 POE-LAX

06/19/08 AOS mailed thru USPS

06/22/08 AOS delivered to Chicago IL

06/28/08 check cashed

06/30/08 received NOA1 dated 06/25/08

07/26/08 biometrics appointment

09/09/08 received EAD card in the mail

12/03/08 received interview letter for Jan 21 2009

01/21/09 approved for conditional permanent residence

02/02/09 permanent residence card arrived in the mail

10/21/10 submit form to remove conditions

01/21/11 10 year gc received

03/05/12 mailed my N-400

03/06/12 received email that they have my N-400

04/05/12 biometrics

thank God for this answer! i was also granted sole custody by the court and i have been wondering about the clearance because i know the biological father would give me a hard time if i asked for a written permission from him.

aug. 26, 2008----transferred to csc

sept. 19, 2008--- approved

NVC:

sept. 26, 2008----got case # from a live operator

oct. 6, 2008 ------received AOS bill/paid online

oct. 7, 2008 ------shows PAID

oct. 14,2008 -----IV fee generated/ paid online

oct. 15,2008 -----shows PAID

oct. 16,2008 -----mailed DS230 overnight

oct. 23,2008 ---- RFE

nov. 3,2008 ----- case complete

nov. 26,2008 --- medical exam

aug. 14,2009 --- remedical finally, passed

aug. 24, 2009 -- interview , passed

aug. 29, 2009 -- visa in hand

sept. 24, 2009 -- POE LAX

hi again. you wont be needing any letter of consent from the biological father as you were already granted full custody of your child. i have the same case for my only son who's also a minor and i only brought copies of decision and finality on my medical. they asked for it and i had to wait for another 10 minutes when they read my petition for nullity of marriage on the ground of psychological incapacity on respondent's side (my ex husband). i was the petitioner therefore i wasnt asked to undergo anymore test based on this. good luck and God bless!

Whoever has FULL custody has the " final say" so you are good to go without the father's consent.

August 16, 2010 - Petition received by USCIS Vermont Center

August 20, 2010 - NOA1 received

October 4, 2010 - Biometrics

January 3, 2011 - Permanent 10 yr. Green Card Received.

For the same reasons that a 44-year old man like you would marry a young, 21-year old girl from PI.

Whatever the reason, it's really none of our business. To each his own.
