Hello,

here's my story... I've filed for a CR1 visa in April 2008 and I got the visa on 30th of March 2009 then traveled to the US in April 8th 2009 (my POE was Houston Intercontinental Airport) after two or three weeks my neighbor knocked on my door and handed me two letters that mistakenly came to his address! when I opened the envelopes I found a welcome notice from the USCIS and my Social Security Card!! then I was like "Damn!!" I knew that USCIS got my home address wrong... I looked into the copy of my DS-230 form that I still keep and I found that I wrote down the right address in there so it's definitely their mistake not mine...

anyways as I was expecting my Green card to arrive in a week or two I had to change my address, so I went to uscis.gov and filled the AR-11 form and corrected the mistake. but still the green card never came... so I called them to inquire about my green card and I knew that they've already sent me the Green Card a month ago and I still never got it! (my neighbor is overseas I can't get him to check his mailbox!) so they (USCIS) told me in case your green card had been [ LOST, STOLEN OR DESTROYED ] you have to file form I-90 to get a replacement! (this will cost $400 BTW)... but none of these situations mentioned apply to me as I didn't Lose it or destroy it nor someone stole it from me 'cause I have NEVER gotten it anyways! it's the USCIS mistake from A to Z so why I have to pay for a mistake they've done.

What I can do about that? as it's a conditional green card good for 2 years should I wait for my 10 years green card or I need to get that conditional one?

You actually need the physical card in your possession. So you cannot wait for the next card.

Was the address on the envelopes correct? or was it a case where the mailman delivered it to the wrong address?

If it was the wrong address (on the envelopes), I would suggest you make an INFOPASS appointment and show this to them - explaining the situation (take the DS-230 showing the correct info) - that way you can prove it was USCIS fault in the lost card.

So you won't be responsible for the cost of replacement.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks a lot Bob. for the response, the address on the envelopes was wrong, just the house number is different.... 8315 instead of 8351.... I guess the INFOPASS is my last salvation..

Is there anyway you can contact your neighbour/ whoeever is looking after his house for him?

If not, I think you will need to pay the money for a replacement card; effectively, your greencard is "lost".

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Lets see what will happen in the InfoPass! about my neighbor I contacted someone and she told me she's going to take a look at the mailbox this week and tell me what's up. but can USCIS ever take responsibility of the mistake they've made? they do sometime, I guess!

You can submit an I-90 Application to Replace Green Card form for free by selecting option B "My authorized card was never received"

is that true?! you seem you've been through the same situation, you didn't pay the fees 'cause it was a USCIS error?! gimme a little insight about your experience, Thanks a lot...

They got my first & middle names mixed up on my green card so I sent it back with that form and they sent me a new one with my correct name, easy as that
