I thought I had my F1 wife's AOS forms completed and ready to file. I went to see an immigration attorney with everything that I got. Everything is good, but he said I need to have my mother complete a seperate I-864, because I included her income in my I-864 to satisfy the income requirement for a household of 3. I thought I only needed to have my mother complete an I-864A, not another I-864.

So, basically this is what he suggested I must have:

-My I-864 (with me and my mother's income figures combined)

-My mother's I-864 (with just her income figure, which by itself (without my income combined) is below the income requirement for a household of 3)

-My mother's I-864A

I think he's wrong, but just to be safe I have to ask you guys.

I do also. If your mother is living in the same residence then she should qualify as a Household Member, and fill in an I864A to add her income to yours. Time for a second opinion!

Hi,

My sister lives in an apt. within my house and was our co-sponsor. She did qualify as a "household member". She filled out an 864 and we (she and I) filled out an 864a.

On the petitioner's 864, be sure to add the household member's income to your own income (there is a section within the 864 that asks you to list your income and household size).

Your immigration attorney IS wrong, god how do these people get away with giving such bad incorrect advice and then charging people thousands of dollars to do this??? (maybe I should look in to a new career change? :P )

as long as your mother lives in the SAME household she only needs to fill out an I-864a, it states that CLEARLY in the guidelines, I was in the same position and we used an I-864a
