My congressmen problems

Timeline

I contacted my congressman what will be 3 weeks on wednesday to help us with enquiring about our case which was submitted on Jan 13th. He hasn't gotten back to me at all and I even emailed him on tuesday and he hasn't replied. Is this unusual behaviour and does it usually take this long for a representative of a congressman this long to get a response to USCIS?

I'm at breaking point cause of all the feb filers who are getting approved and our case seems to be no where near in sight of ending....

I'm considering contacting our senator instead to see if they will be a bit more helpful. Will this cause any problems?

01/08/2009 - POSTED NOA1 to VSC

01/13/2009 - RECEIVED NOA1, Case Pending

02/06/2009 - TOUCHED - Finacee moved so I presume that was the reason for it

05/20/2009 - Contacted Congressman's Alan Grayson's Offices to ask for assistance on our case, He agrees

06/13/2009 - 5 months and nothing, not even from our congressman :( Were is our NOA2!!!!!!

06/16/2009 - Our congressman actually made contact us for the first time in 4 weeks only to tell us they had written our address down wrong so here we are, still stuck in limbo with not a clue what's happenening

06/17/2009 - Called NVC on a off chance they might have it and they do!!!!! Woop woop. All we need now is that hard copy and were set!

06/17/2009 - NVC send our visa and petition to the london embassy - My packet 3 is on the way, woop woop!

06/19/2009 - Recieved NOA2 in the post, dated 06/11/2009. The panicing is over.....for now

07/01/2009 - Reeceived Packet 3 in the post, woop woop

Call me pessimistic, but I wouldn't rely on anyone in government..... including USCIS.

I'm a small businessman, if I don't take care of my customers, they don't call me back........ USCIS??? You have no choice....... Congressman??? they can blow some much bs...... who knows. I know some have had some luck, but I really do not believe these people are working for us, otherwise, things would be much more transparent, and questions could be asked and answered.......Why else would they ask for "daytime phone numbers" and email address's on applications?

I always communicated with mine by phone. Even after sending the initial fax, I call right away to verify that they received it.

But I seem to have gotten a better response from my Senator than my congressman. He actually passed on my info request to USCIS and mailed me a letter about it.

My congressman's office called back to suggest that I schedule an infopass appointment instead of waiting for USCIS to get back with the congressman's office.

November 19, 2007 - Met

November 25, 2008 - Engaged

November 25, 2009 - Married

November 24, 2011 - Baby due!

Timeline

I do not believe that you representatives can do much if you are still within the processing timeframe of six months. Even once you are outside of the timeframe, there is no guarantee that they can speed things along, but at least then they can say that your adjudication is late; at this time you are still within the six month timeframe.

05-11-2009: NOA1

05-20-2009: called the Military Help Line and requested for expedite

06-04-2009: NOA2

06-14-2009: NVC letter received in the mail

07-02-2009: Packet 4 received

08-27-2009: Interview - Visa approved!

09-03-2009: visa in hands.

09-20-2009: POE - Miami

09-21-2009: we got married!

AOS TIMELINE:

05-12-2010: NOA1

06-08-2010: Case transferred to CSC

06-21-2010: Biometrics

There's a lag in time between a Congressional inquiry and the USCIS response to it.

Suggestion (besides InfoPass): Wait until you're 6 months or more past your filing date. Call the USCIS toll-free line, and tell the Misinformation clerk that you want your call to be escalated to an immigration officer (IO). Expect some flak from the clerk, but stand firm, and inform her/him that he/she is REQUIRED to escalate your call upon your request. Once you reach an IO, express your relief and pleasure at being transferred to someone who can really help you (the IOs like this, and it won't take much acting on your part!), provide your case number, gently express your anxiety, and say "I'm aware of several February applications that have been approved already." Next, without making demands or becoming melodramatic, politely ask WHERE ON THE FLOOR your file currently is. Then, ask the IO (politely!) to send an e-mail to the processing floor to ask the appropriate person there to move your file to the next station. Thank him profusely, and wait with hope.

Note to all: The above is NOT advisable if you're within the standard 6-month timeframe.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I had no experience with the congressman but my senators office was quite prompt, i'd say less than a week or so.

but you do have to follow up. call and make sure someone is working on your case and ask whats the latest updates.

It does not guarantee any speediness or confirmations, but what happens is, if your case is forgotten on someones desk, once the senator/congressmans office makes the inquiry those guys wake up to the case.

Thanks everyone for your help and advice, I'm not even at the 6 month mark yet so I'm most likely just over-reacting but seeing people in feb get theirs is very heart breaking as a lot of people on here can understand. I'll just have to wait until the 6 month period is up I guess and just hope in comes in the meantime.

I was just about to ask this question too. Thanks for starting this topic, Todd.

I just went to drop off my information at the local Congresswoman's office yesterday and left a voicemail for the person who's in charge of helping visa applicants, and I was just freaking out that she hasn't returned my call yet... so I guess it may take them a while, then. I was about to ride off and tie myself to her desk or something until she gave me some information.

Does anybody know if it is better to contact ALL of your representatives or just one? On the confidential waiver that you have to fill out for all of them, there are spaces asking if you have asked for any other congressional help and who you have asked. I was worrying that it would make them take me less seriously if I asked all of them, or that they would all assume that the other ones were helping me and not do anything.
