Hi to All VJ member ...

I am newbie in this forum, I wish if someone can help to answer my question :unsure:

Me and My Hubby just filled petition 1-130 for CR1 and CR2 for 2 of my daughters.

What I want to asked in this forum is Do I need custody documents for my daughters ??? since in my divorced certificated it is not mention at all about the children custody. It is a normal case in my country for the children custody goes to their mother. I just want to be prepared for all documents that will needed and the only one that I don't have is Custody documents :blush:

If I need to have that document, from where I can get it ???

What will be asked for at the NVC level is a notorized statement from the other parent allowing the Children to come to the us. This can be done at a notary place in your country. Try and get this soon as you will most likley get an RFE if it is not submitted to the NVC. It says this no where on the NVC documents requested but it is needed. Whether you have the divorce or not they still want to make sure the other parent agrees to the children coming to the US to live. Also you may want to check the exit requirements for the children to leave your country with only one parent. In Colombia they need a authorazation letter from the parents ( or one or the other ) to be able to board a plane if they are under 18.

Why is it that the only one who can stop the crying is the one who started it in the first place?

Thx for your reply to my question, I already check with the US Embassy in Jakarta and the have the same answer like yours :yes:

They said I need a statement from my daughters biological father that allowing them to be lawfull permanent resident in US.

In our case, we wub.png thought that my daughter will be covered on my I 130 so we did not file for her sapratly. After a year when I received my interview letter but not her, we found where we went wrong oops8rh.gif. We filed for her I 130 in last august. Now after we sent the AOS and IV packets NVC has completed the case. I am just waiting for the interview letter. In my case I got divorce with my ex-husband alien.gif on Mutual Consent. The divorce decree says that:



PETITION FOR DISSOLUTION OF MARRIAGE BY


A DECREE OF DIVORCE BY MUTUAL CONSENT


UNDER SECTION 13-B(2) OF THE HINDU


MARRIAGE ACT AS AMENDED UP TO DATE.



In other page inside where my ex-husband has singed the paper:



My marriage was solemnized on (DATE) at (PLACE) as per Hindu rites and customs with petitioner no 1(Me). On (DATE OF SAPERATION) due to some temperament differences and unavoidable circumstances I detached my relationship with petitioner no 1(ME). One female child (NAME OF THE CHILD) was born born out of this wedlock on (DATE) The said female child is in the care and custody of petitioner no 1(ME). I have settled all my disputes with petitioner no 1(ME) and her family. It is mutually agreed between me(my ex) and petitioner no 1(ME) that the custody of the child will remain with petitioner no 1(ME) and I will not claim for the custody in future. I further undertake not to initiate any legal proceedings against the petitioner no 1(ME) and her family.



So do you think that I still need the court custody orders as this divorce was based on mutual consent and yours was on ex party? We are about to get done with our case and I dont want any problems at the time of interview. What you think I should get ready with before NVC assign me an interview date?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
