Teen faces murder charge in West Valley baseball bat slaying

Crime » County has 60 days after arraignment to decide on death penalty.

Salt Lake County prosecutors on Wednesday charged an 18-year-old man with aggravated murder in connection with killing his West Valley City neighbor with a baseball bat during an attempted theft.

The charge means Martin R. Vuksinick Jr. could face the death penalty. Prosecutors have 60 days after his arraignment to decide whether they will pursue the death penalty, said Alicia Cook, a spokeswoman for the Salt Lake County Attorney's Office.

Vuksinick was also charged in 3rd District Court with first-degree felony aggravated burglary and obstruction of justice, a second-degree felony, in the May 22 slaying of Kimberly Hain.

The teen told police he entered the Hain home through an unlocked door and later led investigators to the murder weapon in a field near 6000 West and 2700 South, according to charging documents. The obstruction of justice charge stems from Vuksinick allegedly hiding the murder weapon in the field, Cook said.

Vuksinick may have been using cocaine at the time of the crime, police said. Authorities have said nothing was taken from Hain's home.

An autopsy found Hain, 33, died of multiple blows to the head, charging documents state. She was discovered by her 8-year-old son, who is autistic, and 6-year-old daughter in the bedroom of their home near 6600 West Fanfare Court (3320 South).

The children waited for their father, Douglass Patrick Hain Jr., to come home from his graveyard shift as a nurse. He called police.

Kimberly Hain was last seen alive between 8 and 10 p.m. on May 21, when she bathed the children and put them to bed. She grew up in West Jordan and was a certified nurse's assistant who was working toward a nursing degree at Salt Lake Community College.

Vuksinick's arrest shocked many in their tightknit West Valley City neighborhood, where the Hains and Vuksinick families were friends. He was spotted in the neighborhood watching police conduct their investigation the day after Hain was killed.

The teen told a Salt Lake Tribune reporter he was in disbelief over Hain's death.

"It still doesn't seem real. It's still shocking," Vuksinick said May 23, the day after Hain's body was found.

Four days later, police arrested him on suspicion of Hain's murder.

In my personal medical opinion, drugs are not what makes one kill, it certainly helps one who already has some mental problems and violent, loosen them up to make a fantasy a reality. So if someone tells you they were high and they have a body in their trunk of their car, RUN, cause they are crazy PERIOD. I can honestly tell you I have been high when I was young, drunk, but I can tell you I never had a violent incident. :wacko: If you are facing serious charges you will look to anything for a way out.

spot on and true.......sister ganja..if you are not violent by nature and have strong internal controls..no substance make you commit murder and/or assault
