I got married in Sep of 04 and filed my 130 entire package at vermont (even hired an attorney to do all paper work) and sent it in 2 weeks after our marriage. It has been 18 months now (almost) and we haven't heard anything back. We submitted 2-3 inquiries but no use.

My work permit expires in April so I filed another 765 for renewal. Does anyone know any law that with my current receipt for renewal application allow me to work for 100 days or something? because i am afraid what if the current permit expires then what? i know i can go in for an interim EAD after 90 days but it won't be 90 days when it expires.

any ideas for doing anything with the AOS/EAD? anyone's input would be highly appreciated...and if nothing, please console me :(

i would give that lawyer a call back first off and see what you find from there.

you may want to call your congressman next to start an inquiry.

best of luck to you!!

How frustrating this must be for you!

First of all, do you have your case status number, with receipts? If you do, I strongly advise that you log into uscis.gov's Case Status section and set up an account. Then add your information, so at least you have some record of when these files were touched.

Next, give that lawyer a call and ask for copies of all correspondence she has had with USCIS. You're paying her, after all, and it's my opinion she owes you this at the very least. If there are any outstanding responses, like RFEs and whatnot, they need to be addressed right away.

Where did you submit inquiries to? Getting your case status online is a good place to start, and that at least provides some estimation of how long processing times are, when USCIS last modified your case files. You could try calling the 1-800 number for USCIS to ask about a specific things about your case, but I'm not too sure if that will give you all the answers you need.

If you're within the area of one, make an Infopass appointment to talk to an immigration officer about your case status. It will probably help to put together as good a record as you can of things like:

1. When you filed and where.

2. Copies of any RFEs you received.

3. Copies of any feedback you've had from USCIS.

4. Short summary of when you've tried to contact USCIS.

The Infopass appointment is probably best done after you talk to the lawyer and find out the status of your case.

What does your attorney say? (If you haven't called them about this, you should. This is precisely why you paid good money to have an experienced professional handle your filing.)

St Albans Vermont reports that they are processing AOS applications submitted in Sept 2005. Seems you are a whole year behind schedule if that is where you filed. I would *hound* your attorney.

Thanks for everyone's feedback.

Well, I have contacted my attorney several times and we did 3-4 inquiries with the CIS directly. We also did a congressional inquiry but in all of them they just said they are doing background checks.

I had set up my case status online account shortly after I applied for my application. And I follow up with it from time to time. But no luck :( I am thinking of getting an infopass appointment and going to Baltimore MD (I live in MD). Any other feedback would be highly appreciated. Thanks everybody.

So, I'm still curious -- what did your attorney say on the several occasions when you contacted him/her? Did they say this is normal? This is not normal and here's what I'm going to do about it?

Well, he basically suggested that we do a congressional inquiry, and/or a regular inquiry and we did that. He said there isn't much we can do more than what we are doing, unless if I want to sue the DHS (yeah that sounded funny to me and I was like naah, forget it). But I think if people are recommending the infopass then I will do that then. Thanks a whole lot!
