Hello,

My fiancee is Thai and we are nearly through the K1 process. In mid-2008, my fiancee informed me that her ex-bf wrote an email to the U.S. embassy in Bangkok (falsely) claiming that my fiancee was involved in prostitution in the past in an effort to prevent her from obtaining a visa to the U.S. There is no doubt in my mind that this is false as I feel I know my fiancee quite well. Our concern is that his email is going to have a negative effect on her during her interview. Her ex is not a USC, he is a British national living in Thailand. Her police record is clean, by the way. Is this anything to worry about? I hope not.

Sounds like it might be a good idea for you to attend her interview if that is allowed in Thailand. IF the ex e-mailed her or wrote to her what he had done, might be a good idea to get a copy and have it at the interview if it seems like it could help the situation. I wouldn't present it to them though, I would think the Embassy would occasionally get calls from people trying to prevent another from getting a visa. There no real way to know what will happen. Best of luck.

He did not email her what he wrote. He told a friend of his who is married to her sister, and her sisters husband told my fiancee. I have had dealings with her ex before. He somehow got my U.S. phone number early on in our relationship and was harassing me for a couple weeks. Luckily he gave up.

I would think that some random guy emailing the embassy who isn't even a U.S. citizen would hold very little water, especially since he seems to have motive to cause problems. Then again, who knows.

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

Be prepared to attend the interview with her and if the issue comes up explain that the letter-writer is a disgruntled ex-boyfriend who even harassed you by long distance phone calls for a while and who objected to your fiancee having a relationship with someone else. If there is no police record of prostitution they have no grounds upon which to believe this individual who has a definite agenda. Being there in person to reinforce the fact that this guy is not credible, however, is a very good idea.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

Unfortunately, I don't think petitioners are allowed to even be inside of the embassy during the interview in Bangkok, much less with the beneficiary during the interview.

officials at the embassy are not children to believe in mails from unknowns, they will have her police clearance, and many investigations are done also,so tell her ex bf forget about scandals:)

Consulates have wide latitude. I would think they would give more weight to a clean police record than a letter from a jealous ex. But it is good she is aware of it and can answer questions if need be.

It is always a good thing to have a dumb@ss as an adversary. His diarreha of the mouth tipped her off and she is prepared...GO FORTH!

Of course. However I sincerely do not believe that anything he has said is true. Also, I would imagine that if there was real meat to his claim, there would have been a lengthy administrative processing step that we had to go through, or something to indicate there is a problem before we get to the interview. Nothing like that yet. Just a guess.

I don't think the Consulate (or whoever is in-charge in your fiancee's application) will bite such unsolicited information, and would deny your fiancee's visa on the grounds of alleged prostitution without conducting a solid investigation.

Such allegation is hard to prove, unless otherwise she was charged of prostitution in the past. But you have just said that she's clean (crminal/civil case) therefore just chill and relax. She'll be fine.:thumbs:

Section 212(a) only makes her inadmissible if she was either convicted or admits to having committed a crime. Unsolicited statements from uninvolved 3rd parties aren't likely to have any bearing at all. In fact, unless her ex-boyfriend happened to know her case number, I doubt the consulate would even waste the time to try to find out which application he was talking about. If he's as idiotic as it sounds like he is, he probably said something like "I'm her ex-boyfriend, so I should know!', which pretty much blows any credibility he might have otherwise had because it establishes his motive to lie.
