Wife just got her NOAs for i-130 & etc. So does she stay in school?

Quick question:

I think I know the answer but I want to double check with you guys. My wife was on F-1 visa that will expire this August 2009. We got married and we just got our NOAs today in the mail. So does she still need to enroll classes or she ok to leave the school now? Please advise.

05/17/09 - 05/21/09 - Preparing papers - (i-130, i-864, i-485, i-765, i-693, g-325a).

05/22/09 - Mailed out papers (Priority Mail - since its Memorial Day Weekend)

05/26/09 - Papers delivered @ 9:06 AM and signed in Chicago by JH

06/03/09 - Checks got cleared after 8 days.

06/05/09 - Received NOAs for I-130, I-485, I-765, I-131

06/12/09 - Received BioMetrics letter. :) Hurray!

06/31/09 - AP Approved

07/01/09 - EA Approved & Card production ordered

07/06/09 - Received AP

07/08/09 - Interview Set for 08/20/09

08/20/09 - Interview and got APPROVED

I would recommend she continue her studies (status) - what happens if the application isn't approved?

That was recommended to my buddy who is in the process of marrying a foreign student. (by a lawyer)

However, with the NOA's - her status is "pending", so it's not a problem.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Bobby_Ummit has a point there. If she is not approved, she will be in a neither here, nor there situation. But Bobby, doesn't her status stands cancelled as F1 the moment she applies for AOS? Then does it matter if she continues or leaves school?

We were thinking the same thing saspak. Once we sent our AOS, does it cancel the F1 status? F-1 would expire on August 14 2009.

I dont think it cancels your status, but puts your status on hold till a decision is made. Now, whatever the outcome may be, your previous status is irrelevant and void, since if you are approved, you dont need it, and if denied, theres the exit door.

My thoughts exactly. I have reasons that we should have no problem in the end. I just want to make sure all is well in the end and there are no loose ends.

Applying for AOS does not cancel your existing visa. (however, if your on a work visa, and you use the EAD from the AOS, that can mess you up).

It shouldn't be a big deal to stop going to school.
