I'm glad this was posted. It does seem that the person that PMed you was reported by someone one...mostly likely the landlord. I think that highlights how important it is to make sure your mail is secure (what if he hadn't had a NOA1 as proof? What's with the 2 notices?). Especially if someone else has access to your mail, particularly someone who may not wish you well (family included!).

Si, man, times four. No matter how straightforward-seeming (to some of us) that it would be for him to represent himself before a judge against ICE, what folly it would be to even dream of doing so, considering what's at stake! How can anyone here conceivably recommend anything less than immediate and competent legal representation? We have no idea of the exact documentation, paperwork, allegations, etc. that ICE has against this guy. If he tries to represent himself and is surprised by the smallest detail or is blindsided by something bigger, does the term "dog meat" come to mind? The attorney could also send a "cease & desist" or other letter to the landlord, if such were appropriate.

Regarding "never trust ICE," remember that law-enforcement officials can tell us ANYTHING, including any lie.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

While I appreciate the post, and genuinely feel terrible for the guy that went through this, I'd hate to see a bunch of VJ members become paranoid by this incident. In all likelihood, most K-1 filers will be out of status for a significant time period. It takes time to get married, compile AOS paperwork, file, and get a receipt. I'm not worried about ICE pounding down my door over it. They have plenty of other places to go raid rather than to pound down the door of someone who entered legally.

Again, none of us here know the circumstances for which the guy was brought in. The best advice I've seen here is for the man to seek counsel.

Get a PO box so he can't get your mail. and its a federal offense to open someone else's mail and hide it.

i work for the post services and u need to inform your postmaster that the landlord is opening your mail , he can have an investagesion started too or u can call the inspectors. either way you have to something about someone opening your mail!!! that is a federal crime and i know for a fact they will investgate this. ppl in the past have gone to prison over this. this makes me sick to my stomach as a post carrier knowin this. good luck

That's crazy, poor guy!, we all need to be careful with envious people out there!. ICE, as far as I understand only goes when they are informed there is existance of ilegal immigrants. I assume they don't investigate first, they just belive whatever the informer tells them, shame on our system!.

And yeah they always wake people up in the middle of the night, that happened to a good friend of my cousin. Thanks God she is okay back in her country and doing even better than here!

I agree with those who say:

1. Get a lawyer before going to a hearing with ICE... it seems straightforward, but you just don't know. If money is an issue, check out Catholic Charities in the area (I understand you do not need to be Catholic - or Christian - to avail yourselves of their services). I would also recommend that the USC wife attend the hearing, or whatever it is, and bring along all your K-1 and visa documentation.

2. I think mailing the mail tampering poster to the landlord anonymously is a great idea (even though I was unable to open the link).

3. Shop around for another living situation. This landlord sounds like really bad news. And when you change address, mail the change of address to USCIS on the correct form immediately (and maybe even follow up with an infopass to be sure) and document, document, document. In fact, I'd even consider an infopass appointment now to see if they have any other information (or deficits in your file) that may explain what happened with ICE.

I am not advocating paranoia, I am advocating preparedness. He's already been raided by ICE, ffs! Getting raided by ICE was (apparently) completely unwarranted in this situation and who knows what other unwarranted things could occur if he is not prepared and protected.

Best wishes to your friend for a peaceful life! And I thought it was very sweet what he said about not objecting to living in Pakistan (I wonder how that would be for your USC wife?), and just wanting to grow old together.

im very sorry to hear about all this mess. it does happen most the times i have heard about it is with mexicans or what people assume is mexicans. sometimes for jealousy sometimes cuz they just hate the mexican people in general. even usa citizens have had to defend themselves as being citizen born and raised here.

ICE gets a report and they pick up the person or persons, then is up to that person to prove that they are not illegal.

this person needs an attorney. really going to any kind of court preceding involving ICE with out an attorney is foolish.

that is the best advise i have seen given on this thread.

move out of the apartment and dont leave a forwarding address with the land lord do it at the post office. hand deliver ur change of address to any government agencies ur still dealing with for immigration and get a receipt, if u cant hand deliver it then at least send it by mail with signature required as well as calling it in document it completely.

this might sound like over kill but seems to me better to do all this than to be sorry later because of some mess that landlord has cooked up for the person.

I thought i've had bad landlord but this landlord is way out of bound, It's illegal for him to open your mail, or steal someone mail. Try to get a new place as soon as possible IMPORTANT remind USCIS of your new address. It seems this guy still has a fling for your wife and can't move on, so he's turning nasty.

or I would put a little noticed on the mailbox saying " Illegal to open somebody's else mail box.

I had a bout with my old landlord when I st moved to california, most landlords have keys to the apt. they should use in case of Emmergency, on one occasion, he came into the apt to let a refrigeration technician inside the apt. without advance notice. By law I have to sign a notice to let him inside the house if I am not there. I just let him know i didn't like it, what about if I had my ganja inside.lol

I PUT A HUGE SIGN i bought In Richardson Texas awhile back, I put it on my front door but something you would normally see at business location like Junk yard and stuff.

Updated information on my VJ aquaintance~~

He is moving near the end of this month and wants help doing an address change with USCIS. I've read alot of problems of people who changed their address only to have their mail sent to the old place anyway.

If anyone has changed their address by various ways, would you mind commenting on suggested ways to do it. How would one verify the change has been made? I'm wondering with EAD going one way and AOS going a different place, is it possible to assure his mail won't go the the old apartment and he suspected landlord? I believe his wife (sponsor on I-864) is also required to complete an address change of her own.

Does he have a name and address/phone contact for anyone he's involved with at ICE? If this was me, then as well as filing AR-11 with USCIS, I would want to make sure I had personally informed ICE that I had moved. The last thing he wants is to have agents coming down and arresting him again because he moved while ICE were in the process of taking him to court and they didn't find out his address had changed. That would be Very Bad, I think.

If he can't find an acceptable way to inform ICE of the address change, I would honestly think twice about moving until the court matter is done with (and stake out the mailbox each day to ensure the landlord does not intercept the court summons).

Change address right away, may find a PO Box.

For finding a lawyer, be careful, there are many lawyers are not qualify and cheating on you. Shop around and then make decision.
